KARACHI: The Supreme Court on Friday observed that Democratic governments do not compel citizens to run from pillar to post for enforcement of fundamental rights. Hearing petitions of the Pakistan State Oil against regularisation of 208 contract employees, the Supreme Court?s three-member bench, headed by Chief Justice of Pakistan Mian Saqib Nisar, observed that the fundamental rights of citizens are protected under the Constitution and no organization, either public or private, can be allowed to exploit rights of contractual employees. PSO had challenged the Sindh High Court?s order of regularization of 208 employees appointed in different periods since 1984. Petitioner's counsel Shahid Anwar submitted that the respondents were not direct employees of PSO and their services were obtained through an outsource company. He questioned the jurisdiction of the high court to entertain the petition of contract employees and requested the court to set aside the high court's order. Petitioner's counsel Shua-un-Nabi said the respondents were working in PSO on contract basis for the last several years and the high court had rightly ordered their regularization. The Supreme Court dismissed the petition and observed that the employment of respondents were regularized since they approached the high court, and pension and other benefits be given to them since their date of appointment.
