ISLAMABAD: A converted Hindu girl from Rohri-Sukkur Anooshi and now Maria here on Friday told the Islamabad High Court (IHC) that she with her own free-will embraced Islam and wants to live with her husband. As a proof, she recited Kalima Tayyaba and offered Darood Sharif on holy Prophet Hazrat Muhammad (SAW).
Following this, IHC Justice Shaukat Aziz Siddiqui allowed the couple to live together and directed Islamabad police to provide security to the couple. On the other hand, Maria’s husband Bilawal Ali Bhutto, son of Zulfiqar Ali Bhutto, resident of Sukkur, submitted on oath before the court that he contracted marriage with Maria for life and apprehension expressed by Maria’s mother that he might leave her soon were misconceived.
The IHC bench was hearing in a matter the couple had filed a petition seeking protection of life against Karo-Kari. The IHC declined the request of Maria’s parents seeking custody of the girl for counselling, while observing that she is not a juvenile but an adult. On court’s directions, a meeting was arranged between Maria and her family that lasted for 45 minutes. At first Maria refused to meet her parents, but then she agreed on court’s directions. Maria met her father Anand Lal, mother Kanta Bai, uncle Santosh Kumar, aunty Ajna Bai, maternal uncle Ram Chand and her 12-year-old brother Amar Shiva.
After meeting, she told the court that she embraced Islam with her own free-will and conviction, realising that Islam is the true religion and since childhood she was struggling in her mind to decide about the religion. Further her conversion is not only meant for getting married to Bilawal Ali Bhutto, Maria said.
The IHC bench, in its order said, “She is so firm on her stand that recited Kalma Tayaba and presented Darood Sharif on the Prophet Hazrat Muhammad (PBUH) and made request to the court to allow her to live with her husband in accordance with the injunctions of Islam.”
Previously Maria’s parents had claimed before the IHC that their daughter was kidnapped and forcibly converted to Islam. After meeting, Maria’s father told the court that he was satisfied regarding his efforts to persuade during the meeting, and she was not willing to leave. Maria's mother Kanta Bai, however, said that her daughter did not care about her parents who raised her for 20 years. Kanta Bai requested the court for custody of her daughter so that they may be able to persuade her that she committed wrong and her husband may soon leave her, Kanta apprehended.
Justice Siddiqui in his order noted, “In my view, custody of Maria cannot be handed over to parents with an object that she may be compelled for conversion from Islam to Hinduism. In case they succeed in their efforts, it will further endanger the life of young lady.”
PML-N’s minority MNA, Dr Ramesh Kumar Vankwani, appearing before the court on his own, said that it was mere an effort to enter into the marriage contract which needs court’s attention. The concept of Karo-Kari is alien in the Hindu community, and Maria’s apprehensions of being killed are baseless.
When the court asked if he was ready to take custody of both the petitioners, he replied that only Maria’s custody be handed over to him for the purpose of counseling.
Dr Vankwani said that the forced conversion of Hindu girls building a negative image of the country. He said why it was always girls being kidnapped and converted and not the boys? The IHC bench asked Dr Vankwani that why no efforts being made to introduce legislation in this regard. At which Dr Vankwani said that the PPP government introduced such a bill in the Sindh parliament and that was passed, but then Asif Ali Zardari telephoned Jamaat-e-Islami and the bill could not become law. Talking to The News, Dr Vankwani said that two persons in Sindh were active in conversion of Hindu girls to Islam. One Pir Abdul Haq alias Mian Mithoo and second is Ayub Jan Sarhandi.
In the previous hearing legal counsel for the couple had submitted before the court that due to Stone Age old disgusting traditions of Karo-Kari, life of both the petitioners is under serious threat. In order to execute the black tradition, respondents can go to any extent, he further submitted. He had requested the court to direct ICT IG to provide protection to the petitioners as they want to stay here in Islamabad, and if protection may not be provided, petitioners may not be found alive. The IHC bench issuing the above said order disposed of this matter.
