Nawaz says decision should overturned ISLAMABAD: Despite implementing the Supreme Court orders that led to his ouster, former prime minister Nawaz Sharif on Friday refused to accept the ruling and continued to criticise it at a lawyers convention.He raised a string of questions about the Supreme Court orders and Joint Investigation Team that became the basis for apex court ruling in Panama Papers case.Addressing the All Pakistan Lawyers Convention, held at Aiwan-e-Iqbal, he said the verdict of Panama Papers case raised certain queries which not only confused common citizens but also the law experts.Spelling out the questions, he asked if WhatsApp calls were ever used to nominate the investigators; had the Supreme Court ever made a joint investigation team (JIT) for such a case; were secret agencies members ever tasked beyond terrorism and national security cases; had a three-member bench ever supervised the work of a JIT; did any petitioner seek his disqualification on the basis of a Dubai company and the salary issue; could any court rely on dictionary while ignoring clear laws; had it ever happened that four verdicts were pronounced in one case; could those judges be included in another bench who had already given their decision; could those judges base their decision on a JIT report who had not been part of the JIT hearing bench; in entire judicial history, had a monitoring judge been appointed to oversee the NAB and trial court proceedings, especially if he had already given a verdict; could a trial court work independently under a Supreme Court judge; could the National Accountability Bureau be given any direction beyond the prescribed rules.He said that he had raised all these questions in his review petition with an aim that the verdict, made on wrong basis, should be overturned.Nawaz Sharif said that lawyers had always played a leading role in all movements for democracy after the creation of Pakistan.
Referring to the rule of dictators and dismissal of democratic governments, he said that it was often said that Nawaz Sharif never enjoyed good terms with anyone.Sharif said that there might be some shortcomings in him, but if there was anyone, starting from Liaquat Ali Khan era to the present day, who ever enjoyed good terms with them.He said that it was extremely important to address the root cause which harmed the democracy; otherwise the country might face an accident.
The former prime minister said that the courts not only condoned the rule of dictators in the past but also gave them powers to amend the Constitution.
"People's representatives were jailed and punished but no dictator had ever been punished for abrogating the Constitution," he regretted.He said that a strategy needed to be evolved to further strengthen the Parliament. He asked the lawyers whether there was any precedent in the history of judiciary when a judge, who had earlier given his decision, was made part of a bench that gave the final orders into a case.“I do not seek my restoration (as prime minister), but restoration of people’s right to rule”.He said the Pakistan Muslim League Nawaz has decided to set up a special committee that would initiate dialogue with all the segments of civil society, asking the lawyers, media and teachers to be part of the national dialogue which aims to diagnose the illness griping the country and to find a cure for the malady .Lauding the lawyers for their struggle and sacrifices in lawyers movement, he asked them to contribute in the process of changing people’s fate.He said violation of ballot’s sanctity led to dismemberment of the country and it has also made the country a laughing stock in the international community.“Aim of my struggle is to change the destiny of 200 million people,” he said.
