Justice Kayani expresses displeasure due to **n-production of Zardari’s missing aide, absence of defence, interior secretaries
ISLAMABAD: In a missing person case, an Islamabad High Court (IHC) bench gave the last chance to the Military Intelligence to file reply. In two different cases related to missing persons, the Court severely reprimanded the intelligence agencies and police officials for their denial of the custody and illegal detention of the persons without initiating their legal trials before a court. Justice Mohsin Akhtar Kayani, while hearing into the matters, said that all the law enforcement agencies, including ISI and MI, were formed to protect the country. If you people got an authority, use it in a proper legal way, Justice Kayani said. In the case of former adviser of the Sindh government and close aide of Asif Ali Zardrai --Nawab Ali Leghari -- Justice Kayani expressed displeasure **t only due to **n-production of the missing Leghari but also due to the absence of the secretaries defence and interior. The Interior Ministry denied any information about the missing man and so does the Ministry of Defence. However, a director legal from the Ministry of Defence Col (retd) Falak Naz requested the Court to give some time as Mmilitary Intelligence is yet to perform its ground check. Justice Kayani, at that instance, said: “Produce Nawab Leghari, it’s my order.” The IHC judge said that when you people pick a particular person what prevents you to produce him before a Court of law for trial. At this, the Ministry of Defence director legal said that ISI and MI were spying agencies. They work in support and assistance of civilian agencies and can**t prosecute a person. Col Falak said when we inquire our officials and they say that they don’t have the custody of a particular person what we can do then. Justice Kayani, at that instance, remarked that everybody k**ws where he (missing person) is. The IHC bench then gave last chance to the Ministry of Defence for submission of MI reply and issued **tices to the Intelligence Bureau (IB) director general that was previously **t a party to this case. A brother of Nawab Leghari said in the Court that his brother was picked up by the agencies before his own eyes, and **w they were denying. The Court then put of hearing into this matter till July 12. Petitioner Badarun Nisa, wife of Leghari, in her petition expressed apprehensions that her husband is under the illegal custody of the Interior Ministry. She told the Court that some officials on April 4 came to her house at Sawan Garden in Islamabad and demanded the CNIC from her husband. Afterwards, they took him along, and when the petitioner contacted the police station concerned, it expressed complete ig**rance of the incident. Police even refused to register an FIR initially and that was registered after the matter was reported in the media. The petitioner suspected that Interior secretary was behind the kidnapping of her husband. Separately, in a**ther matter a missing person Umar Yar was produced before the Court who was picked up eleven months ago and before the bench, he burst into tears while saying that he was severely beaten up and kept in a small dark room. He was beaten to an extent that his shirt soaked in blood and he wished for death. Umar Yar said that he was tortured without any justification and reason. Umar Yar, his brother and a servant were picked up from the Islamabad's fruit & vegetable market and according to their counsel they were then taken to Bahawalnagar where Counter Terrorism Department (CTD) registered an FIR against them for possession of four hand grenades, 2.5kg explosives and two detonators and due to links with Tehrik-e-Taliban Pakistan (TTP). A CTD SSP, along with investigation ******r (IO), appeared before the Court and said that the arrested person have links with TTP. After arrest, he was sent to jail. The IHC bench questioned that how long it took you to investigate this fact that accused has links with TTP? At which the IO said, 24 hours. The IHC bench expressed astonishment and displeasure and said that these persons were missing for the last one year. Suddenly you showed their arrest and a fake investigation was made. Justice Kayani questioned the IO that what tell about the make of those hand grenades? Either they were Russian, Chinese or Indian made? The IO could **t reply and simply said that there was ** inscription over the grenades. The IHC bench then questioned that what the chemical composition of explosives you recovered was. The IO could **t answer this question as well and said that it was a yellow substance. The IHC bench then remarked that if you people bent upon committing dishonesty, do it in a proper way. About Umar Yar's second brother, the CTD SSP said that they are **t in his custody. At this Justice Kayani, while addressing the CTD SSP and IO, said that should I ask the inspector general of police, Islamabad, to investigate you. Legal counsel for the petitioner said that when one brother recovered from the custody of CTD, how it is possible that the other one is **t in their custody as both were picked up together. Justice Kayani, at that instance, remarked that how we can think that the other brother is **t in your custody. If these persons have links with TTP, initiate legal proceedings against them but don't lodge fake FIRs, the IHC bench said. The judge gave 10 minutes time to the CTD SSP asking him to think over it and submit a reply. Justice Kayani said that he don't want to pass an order that would affect CTD official's career. At this juncture, Jutice Kayani inquired where the interior secretary is. The Court was told that he did **t come here. The IHC judge expressed an**yance and said that the secretary should k**w how his officials are working. After a short span, the CTD SSP once again appeared before the Court and said that he can**t say anything without consultation of his superiors. The IHC bench said that it would pass a proper order in this matter.
