JIT submits second report; describes some problems in investigation; apex court’s special bench shows satisfaction with investigation; says ** extension in time-frame



ISLAMABAD: The Supreme Court (SC) on Wednesday sought an explanation from the Joint Investigation Team (JIT) about the leakage of Hussain Nawaz's photograph during the interrogation into allegations of financial irregularities and money laundering involving the prime minister and his family for establishing properties abroad.

The SC bench showed satisfaction with the JIT investigation and made it clear that there would be ** extension in the time-frame given to the probing body to complete the investigation.

A three-member special bench of the PanmaLeaks implementation case, headed by Justice Ejaz Afzal Khan and comprising Justice Sheikh Azmat Saeed and Justice Ijazul Ahsen, resumed the hearing wherein Wajid Zia, the JIT head, submitted the second report.

Wajid Zia in his second report submitted before the court that the investigation was going on in the right direction and hopefully would be concluded before the time-frame.

He, however, informed the court about some impediments and problems being faced by the JIT while probing the matter in hand. The court fixed for June 12 the hearing into the plea filed Hussain Nawaz seeking its direction to the JIT to stop the video recording of its proceedings relating to statements and interrogation of the witnesses.

The court also directed Wajid Zia to submit his explanation over the matter. Khwaja Haris, counsel for Hussain Nawaz, told the court that he had filed a Civil Miscellaneous Application (CMA) before it and contended that video recording itself was **t permissible in any law hence such video recording should **t be permitted.

Justice Ijazul Ahsen, a member of the bench, however, observed that it was **t a video recording but a screenshot. In his CMA, Hussain Nawaz through his counsel had prayed the apex court to issue directives to the JIT to immediately stop the video recording of its proceedings relating to recording of statements and interrogation of the witnesses.

He had further pleaded the court to constitute a commission headed by retired or siting judge of the apex court to inquire into the circumstances leading to the leaking of his photo on the social media and to identify the person or persons responsible for the same.

It was further contended in the petition that the photograph release was aimed at humiliating the petitioner and was a violation of his fundamental right to human dignity as guaranteed to him under Article 14 of the Constitution.

Hussain Nawaz also alleged that the JIT members had been pressurising every witness who had appeared before it to change his statement and even to implicate specific person in wrongdoing, and that too under threat of arrest, prosecution and long-term incarceration.

“It is a**ther matter that ** such succumbed to the JIT pressure, but this showed the mala fide of its members who were bent upon misusing and abusing the authority conferred to them, rather it reaffirmed and established their mala fide”, Hussain Nawaz contended.

The judges went through the report for some time and then Justice Ejaz Afzal Khan while addressing Wajid Zia said that he had described his problems in the report, adding that whatever impediments he had he should file a separate application before it, describing all the problems the JIT was facing in smooth sailing of the instant proceedings.

Justice Ejaz Afzal Khan said that after the separate application was filed, they would then ask the learned Attorney General to file his reply. The court directed that the report submitted by the JIT be deposited with the Registrar ******.

Justice Ejaz Afzal once again made it clear to the JIT that the court’s timeframe was hard and unchanged and it could **t compromise on the date it had already given wherein the JIT would be able to file its findings.

“We can**t afford even a day more as well”, Justice Ejaz Afzal Khan remarked and adjourned the hearing till June 12.
