Govt restraint ends judges? Sicilian

ISLAMABAD: After patiently hearing the hard-hitting remarks of the Supreme Court judges during proceedings on the Panama case for months, the government has sharply reacted to the latest comments of the justices drawing a comparison between the Sicilian Mafia and the government.

In his response to the fresh remarks, former attorney general Irfan Qadir said the judges’ comments while initiating contempt proceedings against Nehal Hashmi were premature and unjustifiable. “When the government disowned Hashmi’s speech, the judges gave their findings against him before hearing the case,” he told a TV channel.

Irfan Qadir stated that saying that Attorney General Ashtar Ausaf Ali is a member of this government Mafia was wrong. “I am with the attorney general. The judges have violated their own order by making it a point that two names are included in the Joint Investigation Team (JIT). This is misconduct. The court order had stated that the names for the JIT would be recommended by the heads of different institutions.”

Through its spokesman, the federal government voiced strong reservations over the judges’ ‘baseless’ remarks which, it said, are against the code of conduct and the oath taken by ho**urable judges. “The remarks damaged the integrity and image of Pakistan; the judges leveled baseless allegations against the government without being informed about the matter. The ho**urable judge also didn’t take into account the measures the government took against Hashmi whose opinion has **thing to do with Pakistan Muslim League-Nawaz (PML-N) or the government.

"Importantly, shortly after prime minister came to k**w about Hashmi’s objectionable remarks, he suspended his membership of the PML-N and asked him to resign as the senator. The Supreme Court’s suo moto **tice came after this severe action.

"Are you aware of what is going on around you?" the attorney general, who was present in the court, was asked by the special bench. "It seems that the government's self-proclaimed spokespersons let ** opportunity to malign the courts slip by," Justice Ejaz Afzal remarked.

Justice Sheikh Azmat Saeed said that it was **t our custom to bring our children into our fights. "Mr Attorney General, what kind of people involve children in their fights?" he asked. "The cowardly kind," the attorney general replied. "**, **t cowards — it is terrorists and the Mafia who do such things," the judge responded. "Congratulations Mr Attorney General; it seems that your government has joined the Sicilian Mafia.”

Justice Ejaz Afzal said that they had faced military dictatorships, but even these did **t dare threaten our children. "You stayed quiet for two days after Hashmi's speech and then sprang into action fearing the Supreme Court's retribution," he added. "We constituted the JIT and we are **t afraid of any type of consequences. We were the ones who issued instructions to the Supreme Court registrar. Your government has been creating problems for us," he warned, slamming the misleading campaign being run in connection with the JIT. "Strict action will be taken against whoever mocks the judiciary.”

While the ho**urable judges are also required to keep their cool and observed restraint in passing severe remarks, the government too needs to control itself. Any confrontation between the government and the apex court will be disastrous for both as well as Pakistan. Some circles may want such a fight.

Comparison by the judges between the government and the Sicilian Mafia was uncharitable. This in fact provoked the official spokesman to give a sharp reaction. The government believed that while the Sharif family is fully cooperating with the JIT with Hussain Nawaz’s third appearance before it, facing tough questioning for nearly 12 hours, and Tariq Shafi has been threatened and mistreated by some JIT members, it is still being compared with the mafia. It has also an**unced that the premier will also record his statement when required and his other son Hassan will also appear before the JIT when called. There is a strong feeling in the government that by repeatedly summoning the key members of the first family, the JIT is deliberately humiliating them and dragging the process with vengeance.
