افتراضي IHC asks govt to bring back Pak murder accused held in UAE

ISLAMABAD: A Pakistani murder accused is trapped in the United Arab Emirates (UAE) as his red warrants were issued through Interpol, and Pakistan government has ** extradition treaty with the UAE government.

Mother of the accused Muhammad Ahmed Sardar, Khursheed Begum, has petitioned the Islamabad High Court (IHC) seeking directions for the Ministry of Interior (MoI) to take up this matter with the UAE authorities and bring her son back to the country to face judicial process here.

Justice Aamer Farooq of the Islamabad High Court (IHC), while hearing in this matter, here Friday directed the Ministry of Interior to officially take up this matter with the UAE government and bring detained Pakistani citizen back home to produce before the court concerned within four weeks.

Accused Muhammad Ahmed Sardar, a resident of Bahawalpur, was allegedly involved in a murder case where a district court had declared him proclaimed offender. Later, the Federal Iinvestigation Agency (FIA), on the request of district police ******r (DPO), Bahawalpur, with the approval of Interior Mministry had issued red warrants for the accused.

Petitioner’s counsel Barrister Sehri, while talking to The News, said that there were countries in the world to whom Pakistan has signed extradition treaty and there were countries where this treaty is **nexistent. UAE is a country to whom the Pakistan government has ** extradition treaty. As a matter of process, different countries request the Interpol head ****** in France to issue red warrants for the arrest of their accused.

In the matter of Sardar, Interpol issued his red warrants and on August 6, when he was coming back to Pakistan, UAE police arrested him on the basis of red warrants. **w Pakistani government don’t have extradition treaty with the UAE, so Pakistani authorities have to take up this matter at government level to bring the accused back. From August 6, the accused is imprisoned there.

Barrister Sehri told that it will cost money to the Pakistani government for bringing the accused back, and, therefore, I had requested the court to direct the authorities to suspend his arrest warrants so that the accused could come back by himself and then he could be arrested at a Pakistani airport.

The IHC bench, however, denied this request and directed the Interior Ministry to take up the matter with the UAE government. Petitioner Khursheed Begum, seeking repatriation of his son, has cited the ministry and FIA as respondent. The respondents were represented in the IHC by Deputy Attorney General Malik Feisel Rafique.

Muhammad Ahmed Sardar is allegedly involved in the murder of Muhammad Shahab. Shahab’s body was found from a canal located within the limits of Sama Sata Police Station, Bhawalpur, on October 16, 2011.

Legal counsel for Khursheed Begum told the court that initially Shahab’s father had lodged an FIR against unk**wn persons, but later he had implicated Sardar, his wife Mehwish and some others relatives alleging that the suspects shot his son dead and dumped his body in the canal.

Father of the deceased Shahab, in his complaint had alleged that the accused Sardar was inside country when his son was murdered and later he went to UAE. In February, 2012, a district court in Bhawalpur had issued warrants for Sardar's arrest and later declared him proclaimed offender.

Barrister Sehri argued before the court that the son of his client may be provided with an opportunity to face the trial. All the other accused in this case were acquitted and Sardar was left the sole accused.
