CDA on July 28 had sealed the Mall in the Jinnah Super Market for violating building codes and the original layout plan.On Friday’s hearing IHC beside payment of outstanding amount also directed Mall administration to vacate within two months, ******s established in the two basements of the Mall that were originally meant for car parking. The bench further directed to vacate all the encroached surrounding areas within 3 days where Mall administration has placed electricity generators. A civil judge of Islamabad on July 30 had dismissed petition of the Safa Gold Mall’s administration seeking de-sealing of the building.The mall’s administration then filed an appeal with IHC that was heard today on Friday. In the hearing CDA told the court that Mall owner **t only construed two stories in violation of the approved lay out plan but he also encroached the surrounding area after covering an adjacent nullah where he installed heavy generators and air-conditioning plant. Original area of the building is 3,177 square yards and building plan was approved for a four-story building whereas the Mall administration has constructed 7 stories.The Mall administration on the other hand adopted that they got an approval of 7 stories from CDA. IHC bench then directed CDA to submit an inquiry report before the court in this matter. Separately, in a**ther matter the same IHC bench granted three weeks time to the ministry of interior and foreign affairs to submit reply in a petition of Pak-Turk Education Foundation (PTEF) that approached the IHC against possible closure of PTEF schools by the federal government. Officials from both the ministries informed the court that there is ** proposal to close PTEF schools and these were just news in the media.IHC bench providing time to the ministries adjourned in this matter.The petitioner through its counsel contended before the court that PTEF is a registered organisation. Federal government and Securities and Exchange Commission of Pakistan have duly issued **-objection-certificates to the organisation. The government has ** authority to intrude into the affairs of this organisation but there were apprehensions that PTEF may face closure. PTEF with its school networks around the country has been educating to as many as 21,000 students. The petitioner’s counsel argued before the court that PTEF has **thing to do with the uprising in Turkey. An eight-member board of gover**rs including four Turks and four Pakistanis runs PTEF.
