ISLAMABAD: The intense controversy over Offshore companies has spawned a battle of references between the Pakistan Muslim League-Nawaz (PML-N) and Pakistan Tehreek-e-Insaf (PTI).
They have moved different forums but are unfortunately averse to seeking a genuine investigation into Offshore shells, identified in the Panama Papers disclosures or otherwise, through a judicial commission. The PML-N has submitted the reference against PTI Chairman Imran Khan and his senior associate Jehangir Tareen to National Assembly Speaker Sardar Ayaz Sadiq and thus chose this trajectory instead of the Election Commission of Pakistan (ECP) that the PTI and Pakistan People’s Party (PPP) had preferred. The PPP has also submitted a reference against the Sharif family with the ECP. All these petitions target Prime Minister Nawaz Sharif and his close family members. The PML-N selected Friday to move against the senior most PTI leaders just two days before they are launching a**ther public protest, demanding accountability of the prime minister. What will be the decision of the ECP on the PTI and PPP references became sufficiently evident the other day when the two parties failed to come out with any convincing arguments in support of their allegations. PPP lawyer Latif Khosa even failed to read the document on which he had based his case saying that it was ineligible. When he was unable to make anything out of this paper, how he will get relief or how his plea will be accepted by the ECP is an open question. Ironically, when the ECP asked whether the prime minister’s name figured in the Panama leaks, the lawyers representing the PTI and PPP responded with a big **. Then, it is apparently difficult for the ECP to proceed meaningfully with the references whose fate will be decided shortly. Former High Court judge Shaiq Usmani told a TV channel that these references would be dismissed by the ECP because they did **t point out any violation of articles 62 and 63 of the Constitution, which deal with qualifications and disqualifications of federal and provincial legislators. On the other hand, there is a lot of meat in the PML-N reference against Imran Khan and Tareen because both have admitted, though belatedly and after their Offshore companies were dug out by this newspaper, that they owned them. There are many questions about the source of funds used in establishing these Offshore shells and the purchase of properties in Britain by the PTI chief and Tareen through them. Even if the PML-N reference meets all the conditions, prescribing disqualification of the duo, it will be a difficult decision by the speaker to forward it to the ECP for **tifying their unseating because the PTI has often raised questions about his impartiality after he had defeated Imran Khan in the 2013 general elections. It was on the PTI chief’s petition that Ayaz Sadiq was unseated by an election tribunal. Later, he was re-elected in a by-election from the same Lahore constituency, fielding out a**ther PTI **minee, Aleem Khan. “We have full info about Khan’s income between 1981 and 2015,” Federal Minister Mohammad Zubair said in a ****** of tweets after handing over the reference to the speaker. The income declared by the PTI chairman does **t justify his property. He said the reference pointed out tax evasion, undisclosed income source, money laundering and consistent financial irregularities over 34 years. Anyone with some morality will try to come clean before waging “Jihad”, he posted and also wrote that with charges of tax evasion, money laundering, wrong asset declaration and Offshore company, Imran Khan will start his agitation accusing others. Zubair said that under the Federal Board of Revenue (FBR) rules, a gift is applicable only between husband and wife. Imran Khan could **t claim tax exemption since he had been divorced. Whitening scheme in 2000 was only for individuals, he wrote while the PTI chairman’s flat was in the name of Niazi services which could **t claim benefit. Imran Khan had made a wrong claim. He also said that the PTI chief formed the Offshore company in 1983 and bought flat in its name. In 2000, under a whitening scheme he showed his flat for the first time. Imran Khan earned fewer than Rs100,000 till 1983 according to his own records.
