** lease granted after founding of buffer zone, Punjab govt tells SC



ISLAMABAD: The government of Punjab informed the Supreme Court (SC) on Wednesday that **t a single lease had been granted after the establishment of buffer zone.

A two-member bench of the apex court headed by Chief Justice Anwar Zaheer Jamali resumed hearing in the stone crushing case of Margalla Hills.In compliance, of the court’s earlier order, Assistant Advocate General Punjab, Mudassar Khalid Abbassi submitted a report stating that **t a single lease has been granted after establishment of the buffer zone.

He said that quarrying is allowed for building of bridges and roads adding that they have allowed mining into 53 blocks. He further submitted that they are **t allowing mining in buffer zone and national parks as well.Similarly Director General Mines told the court that stay orders have been granted by courts in cases related to the matter.

The court then directed DG Mines that ** illegal activities are allowed in the areas with the ruling that its earlier order of June 3, 2016 is modified to the extent that it will **t affect the mining lease in 53 blocks. The court ruled that mining can**t be allowed in buffer zones and national parks areas as categorized in A, B, C.

During the course of hearing the Chief Justice observed that whenever they visit Taxilla, they found that the authorities have destroyed the Margalla Hills. We don’t want to make people jobless but we have to protect the environment”, the Chief Justice remarked.

DG Mines however, submitted that the stone they use in building of bridges and roads are only available in Taxilla and Sargodha. The Chief Justice, however, observed that the court does **t want to halt mega projects which are in the interest of the country but rules prescribed for healthy environment must be followed.

Barrister Aitzaz Ahsan counsel for Fecto Cement submitted before the court that despite having valid lease, the police are making hurdles for them. The court however, asked the learned counsel to approach the relevant forum.

Barrister Ali Zafar, counsel representing a stone crushing association also appeared before the court. Rana Muhammad Waqar, Additional Attorney General for the federation and a law ******r for Khyber Pakhtunkhwa, told the court that in compliance with the court’s earlier direction, they have submitted their respective replies.

The court ruled that it will go through the reports and adjourned further hearing until August 5.Former Chief Justice Iftikhar Muhammad Chaudhry on October 25, 2013 while hearing a suo moto case pertaining to Margalla Tunnel had restrained the Capital Development Authority and National Highway Authority **t to undertake any exercise towards the construction of Tunnel in the Margalla Hills en-route to the province of Khyber Pakhtunkhwa and the CDA was also directed **t to grant licence of crushing stones from the Margalla Hills.
