Lawyers leader stresses need for fresh probe ISLAMABAD: The police and medical ******rs have pointed various flaws in the report of the Supreme Court Bar Association (SCBA) on Murree schoolteacher burning case, terming it mere assumptions without evidence and witnesses. Talking to The News, a senior police official involved in the probe said there was **t even an iota of doubt about the suicide of the girl. He said the police report had quoted forensic evidence, mobile phone record, CCTV footage, geo-fencing and statement of the doctor to declare the incident a suicide but the SCBA report did **t include any evidence to prove it was a murder. A fact-finding mission of the SCBA has declared the burning of schoolteacher Maria Sadaqat a murder, rejecting the police report. But, surprisingly the report issued by the top lawyer’s body does **t include version of accused party at all. The report was prepared after a single visit of the mission to the site of reported crime in Murree. While contacted by The News, President of SCBA Syed Ali Zafar said he wanted a new independent inquiry by the police as the previous police inquiry was **t fair as per the mission’s report. However he admitted that the lawyer body’s report did **t include the version of the accused party saying the lawyer body tried to contact the other party but accused were in police custody and could **t be reached despite effort. The SCBA report has based its claim of murder on two assumptions. Firstly, the girl could **t have chosen burning as a method of suicide as there were easier methods like poisoning and slitting the wrist to do the same. Secondly the report says since the face, hands and feet of the victim remained safe while the rest of body was burnt, it means she was held to ground by four people during the incident. However according to a spokesman of the Burn Centre at Pakistan Institute of Medical Sciences (Pims), Dr Isaac Ashir, dozens of women are annually brought to Pims after attempted suicide by burning. It is a common k**wledge that almost every household in areas like Murree has kerosene to burn wood for cooking. Sometime the same product is used for suicide attempt by women in these areas. Secondly, the fact that the hands, face and feet of the deceased did **t burn could **t prove that the girl was indeed murdered as the postmortem report did **t show any signs of torture on her body. A doctor who treated the victim at Pims also told The News that there were ** signs of torture on her body. “It is almost impossible to burn someone without facing any resistance. But the hands and face of the victims were clear of any torture signs or even bruises,” the doctor said. The postmortem and forensic reports showed ** sign of torture on Maria’s body or any evidence of rape. Polygraphic test and fingerprints tests also revealed that the accused Master Shaukat, Riffat Mehmood and Mian Arshad were **t involved in the crime. CCTV footage also revealed that the accused were miles away near the GPO Murree at the time of the occurrence. It is worth mentioning that the forensic report was prepared by Punjab Forensic Science Laboratory in Lahore which showed ** fingerprints of the accused on the bottle of petroleum product which was used to burn Maria. The postmortem was conducted by Tehsil Headquarters Hospital Murree and the victim died at Pims. It is also hard to assume that so many departments of the governments located miles away from one a**ther and run by separate administrations collaborated with the senior police officials including a Deputy Inspector General to prove it a suicide instead of murder. According to final investigation report of the police the mobile data record showed around 6,248 calls and text messages between the deceased Maria Sadaqat and the accused Haroon. While talking to The News, people of the area also doubted the motive of "murder". "It is very difficult to assume that a 60-year-old father and other elderly relatives who are accused would burn a girl simply for refusing to marry Haroon who is already married with a daughter," said Anwar-ul-Haq a resident of the area. The SCBA mission report did **t comment on the forensic evidence, postmortem report or mobile phone data while rejecting the police report. The report also lambasted doctors treating the patient for **t recording the statement of the patient. However, according to police investigation, a female doctor treating Maria in Murree had stated that the family of the victim was more interested in the statement than the treatment of the patient. The SCBA report emphasised that the statement of victim on death bed which mentioned the names of accused should be given more importance. Talking to The News, SCBA President Ali Zafar further said it could be possible that elderly accused arrested by police were in**cent but the fact that only middle part of the victims’ body was burnt clearly pointed to her murder. “After visit of our team we discussed the case with senior lawyers and we all are unanimous that it could **t be a suicide. We are sure the girl was murdered although we may **t k**w who killed her as it was **t the mandate of our team,” he said. SCBA president said the victim remained alive for 40 hours after the burning and her statement was more consistent with the circumstances. He said SCBA sent its team to ensure impartial investigation into the case but it was **w of the view that the police probe was **t fair. “We want a new probe by the police and re-checking of the fact and if a new inquiry is **t ordered by the government, we will move high court for this purpose,” he said. Ali Zafar was of the view that 90 percent suicide cases were made up after the killing of the victim. When asked how it was possible that four separate departments of the government could reach the same conclusion of suicide, he said the SCBA doubted the impartiality of the probe as the accused were influential people. When asked why ** evidence was mentioned in the SCBA probe and the report was prepared only after one day visit to Murree, senior lawyer said it was **t the mandate of the mission to find evidence as it was aimed at checking the impartiality of the police probe. “We have reached to the conclusion that police probe was **t impartial,” he said.
