Government will issue PP regulating police assignments in civilian positions, completed in January 2026

Jakarta – Coordinating Minister for Law, Human Rights, Immigration and Corrections, Yusril Ihza Mahendra, said that the government chose to issue a Government Regulation (PP) instead of immediately revising Law Number 2 of 2002 on the National Police of the Republic of Indonesia (UU Polri) in regulating the assignment of Polri members outside the police structure. Yusril said that the steps in drafting the PP were taken to resolve legal issues following the decision of the Constitutional Court (Court). “The government is currently focused on solving the problems following the Constitutional Court’s decision and the controversy over Perpol Number 10 of 2025 so that it does not spread elsewhere. Drafting the PP will clearly be faster than drafting the Act. That is why the President has chosen to regulate it through the PP,” Yusril told journalists on Sunday (212/152). Yusril explained that Section 19 of Law Number 20 of 2023 on State Civil Apparatus (UU ASN) strictly stipulates that certain ASN positions can be filled by TNI soldiers and members of the National Police, with further provisions to be regulated in government regulations. In this way, the drafting of the PP becomes a clear and constitutional legal basis. Scroll TO CONTINUE WITH CONTENT Meanwhile, Article 28 paragraph (4) of the National Police Act confirms that members of the National Police can hold civilian bureaucratic positions outside the police if they have retired or resigned. According to him, the latest OB will regulate any posts related to the police so that they can be filled by National Police personnel. “The OP that has been drawn up is intended to implement Article 28 paragraph (4) of the National Police Act, the decision of the Constitutional Court, as well as Article 19 of the ASN Act. This OP will later replace and at the same time reorganize which posts can be filled by members of the Police that were previously regulated in Perpol Number 10 of 2025,” he explained. Yusril then touched on the job regulations for TNI personnel which are regulated at the legal level in Law Number 34 of 2004 on the Indonesian National Defense Force (UU TNI). He emphasized that the choice of legal instrument is the policy of the legislature. “The TNI Act chooses to regulate it directly in the law. With PP there are no problems either. Even though Article 28 paragraph (4) of the National Police Act does not expressly order further regulation by PP, based on Article 5 of the 1945 Constitution, the President has the authority to determine PP to implement the law as it should,” says Yusril. He added that the decision whether the National Police Act will be reviewed or not depends entirely on the results of the work of the National Police Reform Acceleration Commission chaired by Jimly Asshiddiqie, as well as the president’s policy direction after receiving recommendations from the commission. “Whether or not the National Police Act will be changed in the future depends on the results of the work of the Commission for the Acceleration of Police Reform and the President’s policy after the commission has completed its work,” he said. Yusril revealed that the process of formulating the PP started two days ago with the Ministry of PANRB, the Ministry of State Secretariat and the Ministry of Law, under the coordination of the Coordinating Ministry for Kumham and Imipas. The president, said Yusril, approved the arrangement for the assignment of national police members in civilian positions to be carried out by the PP. “It is hoped that the PP will be completed by the end of January 2026,” concluded Yusril.
