افتراضي Death by accident cannot be considered as Qatal-e-Khata, declares SC

KARACHI: The Supreme Court (SC) on Monday disposed of an appeal of a convict in a murder case commuting his life imprisonment to the sentence that he had already undergone in the prison and set him free after 10 years.Mansoor Khan was sentenced to life imprisonment by the trial court for causing Death of his friend at a farmhouse situated in the Sharafi Goth area in 2008. The SC’s three-member bench, headed by Chief Justice Asif Saeed Khan Khosa, observed that true interpretation of Qatal-e-Khata and accidental Death is essential while deciding such nature of cases. The court observed that Death by accident could not be considered as Qatal-e-Khata (death by mistake).The court observed that if a bullet is fired accidentally and causes Death of a person, it would be considered as accidental Death rather Qatal-e-Khata.The court observed that if the case falls within the purview of Qatal-e-Khata, then the appellant had already undergone his punishment. The court disposed of the appeal by commuting the sentence of the appellant that he had already served in the prison.In another appeal, the court set aside the life imprisonment of a convict in murder case and ordered to release him if not required in another case.Riaz Chandio was sentenced to life imprisonment by the trial court for murdering Abdul Haleem Junejo in 2007 in Hyderabad. Appellant's counsel submitted that the appellant was falsely implicated in the case and the prosecution failed to prove charges against his client. The court after perusal of the evidence set aside the high court and trial court's order and ordered to release the appellant if not required in other cases. The court also set aside the conviction of three accused involved in kidnapping for ransom case. Mohammad Yousuf Bugti, Hakim Ali and Shaukat Ali were sentenced for life imprisonment by the trial court in a kidnapping for ransom case.The Chief Justice observed that court had decided six appeals which were fixed for hearing before the court and no adjournment request would be accepted.Death accident cannot considered Qatal-e-Khata,
