افتراضي IHC disposes of Zardari?s missing aide case after he returns home

ISLAMABAD: The Islamabad High Court (IHC) bench here on Wednesday disposed of a petition after the petitioner withdrew this in the matter of former Adviser to the Sindh government and close aide of Asif Ali Zardrai, Nawab Ali Leghari, who returned home on July 24 after remained missing since April 4 this year.

On July 24, some persons dropped him near his home in Sawan Garden, Islamabad. Badrun Nisa, the wife of Leghari, stated before the court she had lost all hopes of seeing her husband again and it is just due to the efforts of this court that her husband returned. She requested the court that she wanted to withdraw her petition that the court allowed. During the last hearing, the court of Justice Mohsin Akhtar Kayani had directed ministries of interior, defence and intelligence agencies working under them to produce the missing Leghari, within five days or the court will pass a judgment that official respondents would have to face.

In the previous hearing, the ministry of interior, defence and intelligence agencies working under these two ministries, beside the Intelligence Bureau (IB) had denied the custody of Leghari. The IHC then remarked that everybody k**ws that the missing Leghari is in custody of intelligence agencies and if **t produced they will have to face consequences of the judgment.

Petitioner Badarun Nisa in her petition had expressed apprehensions that her husband is under the illegal custody of interior ministry. She had told the court that some officials on April 4 came to her house in Sawan Garden in Islamabad and demanded CNIC from her husband. Afterwards, they took him along and when the petitioner contacted the concerned police station, it expressed complete ig**rance to the incident.

The police even refused to register an FIR initially and that was registered after the matter was reported in the media. The petitioner had suspected that the interior secretary was behind the kidnapping of her husband.

Separately, in a**ther matter, the IHC bench directed the Ministry of Defence and intelligence agencies to submit report in the case of a**ther missing person Mehfooz Yar till September 11.

Brother of missing Mehfooz Yar, Umar Yar, was produced before an IHC bench on June 16 at directions of the court. Umar Yar had told the court that he and his brother was kept at the same place but law enforcement agencies were denying custody of Mehfooz. Justice Kayani expressed resentment and said that intelligence agencies have failed as a person is in their custody for the last one year and they could **t complete investigation.

Ministry of defence sought time to submit reply, at which Justice Kayani said that how much time you need, **w it is one year. IHC bench directed the respondents to release the man and if he has committed any illegal act, he may be prosecuted before a court of law.

Mehfooz Yar and Umar Yar and a servant were picked up from the Islamabad's fruit & vegetable market and according to their counsel they were then taken to Bahawalnagar where Counter Terrorism Department (CTD) registered FIR against them for possession of four hand grenades, 2 and half kg explosives, two detonators and due to links with Tehrik-e-Taliban Pakistan (TTP).
