افتراضي SC issues Dr Asim **tice on NAB?s plea for bail cancellation

ISLAMABAD: The Supreme Court on Friday issued a **tice to the former Federal Minister for Petroleum & Natural Resource, Dr Asim Hussain, in a petition filed by the National Accountability Bureau (NAB) seeking cancellation of his bail in two references.

A three-member bench of the apex court, headed by Justice Ejaz Afzal Khan, resumed hearing into Dr Asim’s plea to remove his name from the Exit Control List (ECL) as well as a NAB petition requesting cancellation of his bail.

NAB had filed a reference against Dr Asim, along with top officials of the Sui Southern Gas Company (SSGC) and the Oil and Gas Development Company Limited (OGDCL) over misuse of their authority to award five gas field contracts to the privately-managed Jamshoro Joint Venture Limited (JJVL). Besides, NAB had also filed a**ther reference against Dr Asim Hussain and others in an accountability court for alleged corruption.

In March, the Sindh High Court granted bail to Dr Asim Hussain on medical ground in the matter of two NAB references that Dr Asim Hussain is allegedly involved in Rs462 billion corruption. The court had issued directives to Dr Asim Hussain to deposit Rs2.5 million surety in each case, along with his original Pakistani and Canadian passports, with the court official. Dr Asim Hussain, however, challenged the Sindh High Court order before the Supreme Court, through his counsel Sardar Latif Khosa, praying that he was in dire need of medical treatment which is **t possible in Pakistan. He had also prayed to the apex court to issue directives for removing his name from the ECL.

Similarly, NAB had also challenged the Sindh High Court bail, granted to Dr Asim Hussain on the grounds that ** medical problem the accused was facing which can**t be treated in Pakistan.

NAB’s special prosecutor Nasir Mehmood Mughal requested the court to hear into his plea for cancellation of Dr Asim Hussain’s bail before deciding the ECL matter. He contended that the Sindh High Court has **t gone through all the facts of the case and granted bail to Dr Asim Hussain, saying it is possible to provide medical treatment to Dr Asim in Pakistan.

The NAB special prosecutor submitted to the court that ** medical professional in Karachi is ready to give opinion against the will of Dr Asim, adding that a hospital in Karachi has facility for medical treatment, but it is surprising the hospital administration has changed its website page about a disease which Dr Asim Hussain facing on once heard about nature of Dr Asim Hussain medical problem.

Justice Ejaz Afzal Khan observed it may be possible to constitute a medical board from the experts of all provinces of the country. Latif Khosa, counsel for Dr Asim, however, argued that there is ** any precedent in the medical history to form a board of doctors of all the provinces in a case.

At this, Justice Ejaz Afzal Khan observed that it is also unprecedented that 10 medical boards have been formed for medical examination of a patient. NAB special prosecutor, without citing former army chief and President Pervez Musharraf’s name, contended that people who were granted bail on medical grounds were found dancing abroad.

Justice Ejaz Afzal Khan observed that it is a routine matter that medical boards propose medical treatment of every big man abroad to which Sardar Latif Khosa said that NAB is **t capable to arrest those leaders who are dancing abroad.

Justice Manzoor Ahmed Malik, a**ther member of the bench, asked Khosa to restrict himself to his client case rather than giving remarks for others. Meanwhile, the court issued **tice to Dr Asim in the matter and adjourned the hearing till July 20.
