Do court instructions cover WhatsApp/ Facetime calls?
 ISLAMABAD: Special Bench of the Supreme court on Thursday confirmed that the apex court’s Registrar made calls to some departments for the constitution of JIT on Judges’ instructions, however, confusion still remains whether the court’s admission covers the WhatsApp/FaceTime calls about which even both the SECP and SBP had ** clue who made them.If the Special Bench’s remarks do confirm that the Whatsapp/FaceTime calls were made by the Registrar than the vital question arises if the direction, allegedly conveyed by Registrar, of including specific names in the panels of respective departments was in line with the verdict of the five-member SC bench in Panama case handed down on April 20, 2017. Interestingly neither the Chairman SECP in his April 28th letter written to the SC Registrar **r the State Bank of Pakistan in its internal **te concluded that the Whatsapp/FaceTime caller was the Registrar. Instead both doubted this and for the same reason did **t include the specific names in their respective panel for JI. It is **t clear that the Special Bench’s Thursday’s response on the Whatsapp call issue confirms or denies whether the Whatsapp caller was the Registrar. On Thursday, the Supreme court tried to address the controversy surrounding the issue of WhatsApp call, allegedly made by a person who claimed to be the Supreme court Registrar. While hearing PML-N Nehal Hashmi’s contempt of court case, an ho**urable judge included in the bench explained that it were the judges who inquired about the antecedents of the probe team and asked the Registrar to make the calls. After considering who was who, the bench passed the order to appoint a JIT consisting of six members. “We read many things which are magnified, exaggerated and blown out of proportion,” Justice Ejaz Afzal Khan is quoted by the media to have said, adding that the court knew what to do. It should be recalled that the Chairman SECP in his 28th April letter addressed to the Registrar SC while discussing the secret call issue doubted that the secret caller was the Registrar. Referring to the details of the secret call, the Chairman said, “This has raised a serious doubt in my mind. Since, I have ** means to verify the veracity of the aforementioned call, I am **t considering it. However, I feel it is my duty to bring on record the aforementioned uncanny situation for information and record of the Ho**urable Supreme court of Pakistan.” Similarly, the SBP officials when approached through Whatsapp despite the caller’s claim doubted that he was Registrar SC. The SBP document while referring to the Whatsapp call demanding the inclusion of Amer Aziz name in the panel for SC’s consideration, said, “Later on a fax was received on the fax number of Gover**r ****** on 27th April 2017 at about 2:55 pm, desiring therein two more names in connection with constitution of JIT. They have also desired that the requirement may be fulfilled by tomorrow i.e. 28th instant. However, there are ** instructions of any particular name to be included.
