افتراضي PML-N, PTI?s politics of hypocrisy exposed before ECP

ISLAMABAD: politics of hypocrisy was exposed before the Election Commission of Pakistan (ECP) on Wednesday, both in the case of the PML-N and PTI, when leaders of the two parties established that what they seek from the commission for their adversaries, they don’t approve it for themselves.

Both the PML-N and PTI have approached the ECP seeking disqualification of each other’s leadership. However, in their own defence, both the parties have challenged the jurisdiction of the commission to hear the cases filed against them.

On Wednesday, the counsel representing Prime Minister Nawaz Sharif in references filed by the PTI and others seeking his disqualification on the basis of PanamaLeaks, challenged the commission’s jurisdiction to hear these references.The PM’s counsel, who was supposed to file the premier’s response before the ECP during the hearing, argued that the commission should first determine the question if it had the authority to hear these cases against the prime minister.

Similarly, the counsel representing Captain Safdar, husband of Maryam Nawaz and PML-N’s MNA from Mansehra, refused to file his client’s response and insisted that first the commission should determine if it had the authority to hear the case.

In the case of reference against PTI’s top leader Jehangir Tareen, his counsel also challenged the ECP’s jurisdiction and argued that this question should be settled first.All these references seek disqualification of the persons named. Following the PanamaLeaks, the PTI, besides PPP, filed a reference against the prime minister seeking Nawaz Sharif’s disqualification. The PML-N, instead of directly approaching the ECP against the PTI’s top leadership, moved references against Imran Khan and Jehangir Tareen through the National Assembly speaker. In these references, the PML-N sought from the ECP disqualification of Imran Khan and Jehangir Tareen. However, the hypocrisy is that both the parties want from the ECP to proceed against their opponents but challenges the commission’s powers when it comes to their own cases.

The ECP last month had sought response of Prime Minister Nawaz Sharif and others on the cases filed against them by early this month. Initially, the PM’s counsel sought more time but on Wednesday, the ECP’s jurisdiction was challenged.

Interestingly, the PTI adopted the same strategy. During the hearing by an ECP full bench in identical petitions seeking disqualification of Prime Minister Nawaz Sharif early this month, it was the chief election commissioner, who had pointed out to PTI’s senior lawyer Hamid Khan that there was a**ther case (against Imran Khan) in which the party’s stance was that the ECP did **t have the jurisdiction to hear the case and investigate potential violations of relevant laws.

The CEC, on that occasion, had pointed out that even after the commission had ruled that it had all the powers under the Constitution and relevant laws to hear the foreign funding case, the PTI had challenged the order and filed a writ petition in the Islamabad High Court. “And yet in its reference filed against the prime minister and others, the PTI is arguing that the ECP has all the powers to hear and scrutinise the past records,” the CEC was quoted to have said.

While deciding to club Nawaz Sharif and Imran Khan/PTI cases early this month, the CEC had said: “The reason for clubbing the two cases together is precisely for this reason that I would like to hear from the PTI on why it has two contradictory and divergent stances on principally the same issue of ECP jurisdiction in two cases with underlying similarities.” As against the PTI, a similar contradictory stance was taken by the PML-N on Wednesday before the ECP.
