افتراضي SC issues Husain Haqqani?s arrest warrant

ISLAMABAD: The Supreme Court on Thursday issued an arrest warrant for Pakistan?s former ambassador to the United States Husain Haqqani in the famous Memogate case.
Headed by Chief Justice Mian Saqib Nisar, a three-member bench of the apex court heard the case. The two other members of the bench are Justice Umer Ata Bandyal and Justice Ijazul Hassan.
In pursuance of the Feb 8 court order, Additional Attorney General Waqar Rana told the bench that the Federal Investigation Agency has requested the Interpol for issuing the red warrant for Haqqani.
He said the issue has also been discussed with officials of the foreign and interior ministries, as well as the FIA chief. He said a committee has been constituted to take up the issue with the relevant authorities in the US. The Additional Attorney General said although the FIA has approached the Interpol as per the standard operating procedure, the agency needed an arrest warrant issued by the court. At this, the court issued an arrest warrant for Husain Haqqani. In the last hearing, the federal government had assured the apex court that all measures would be used to repatriate Haqqani back.
During the hearing, the court went through its previous orders and observed that after his resignation, Haqqani was allowed to go abroad on the assurance that he would return, but he never did. The 'memo' in question, allegedly delivered to the American officials at Haqqani's behest in May 2011, had exposed a serious rift between the PPP government and the army after a US-based businessman highlighted the issue.
The court asked Waqar Rana to read out the court orders passed on January 3, 2012 and June 4, 2013. In its January 3, 2012 orders, the bench noted that Haqqani had filed an application with the apex court giving an undertaking that he will fully cooperate with the commission and prayed for permission to go abroad with the commitment that he will return whenever the court required. After furnishing the undertaking, the court allowed him to proceed abroad.
Similarly, in the June 4, 2013 order, the bench noted that Haqqani?s counsel had told the court that the orders had been communicated to Haqqani but he was not coming back, while apprehending threat to his life. The court had then directed the secretary interior to bring Haqqani to Pakistan and sought a reply from the government in four weeks.
After going through the previous orders, Chief Justice Mian Saqib Nisar said he will seek an explanation from his office as to why the instant case was not fixed. Waqar Rana assured the court that all measures would be taken to bring Haqqani back and sought some time in this regard.
In the second case, the Federal Investigation Agency arrested former chairman Evacuee Trust Property Board (ETPB) Asif Hashmi from the Supreme Court over misappropriation of funds.
A three-member bench, headed by Chief Justice Mian Saqib Nisar, was hearing a case pertaining to sale of the Trust?s billions of rupees worth of land to the housing societies in Rawalpindi, Islamabad and Lahore.
Hashmi appeared before the court and thanked the chief justice for summoning him. The chief justice then ordered the FIA to take him into custody. Hashmi pleaded innocence saying the FIA has submitted forged documents in the court.
Hashmi?s counsel told the court that his client had come to Pakistan in pursuance of the apex court orders and appeared before the bench voluntarily. He further told the court that interim bails had been obtained in two cases from Central Judge, Lahore Mohammad Rafiq. The court was also informed that six FIRs were registered against Hashmi in Lahore, one in Islamabad and two in Karachi. The chief justice directed the FIA officials to cooperate with the counsel.
DG FIA Bashir Memon informed the bench that three cases were registered with the NAB against Asif Hashmi which have been handed over to the FIA.The chief justice observed that the ETPB made an illegal agreement with the housing societies as the Trust land could not be sold or exchanged with some other land. Hashmi is associated with the Pakistan People?s Party and served as the ETPB chairperson from 2007 to 2013. After completing his tenure, he left for Dubai in April 2016 where he was arrested.
