The package also provides for forfeiture of security deposit in case a contestant bags less than one-fourth of total votes and gives half term each to the two candidates if their votes are equal. The Election Commission of Pakistan (ECP) has been given powers to partially or wholly declare void an election if the turnout of women voters is less than 10pc of the total votes polled in the concerned constituency. Explanation to section 9 says if the turnout of women voters is less than 10pc of the total votes polled, the ECP may presume that the females have been restrained through an agreement from casting their votes, and may declare polling at one or more polling stations or election in the whole constituency, void. The ECP may order filing of complaint before a court of competent jurisdiction against persons who entered into such agreement. Under section 9, if, from facts apparent on the face of the record and after such enquiry as it may deem necessary, the ECP is satisfied that by reason of grave illegalities or violations as have materially affected the result of the poll at one or more polling stations or in the whole constituency including implementation of an agreement restraining females from casting their votes, it will make a declaration accordingly and call upon the voters in the concerned polling station(s) or in the whole constituency as the case may be to recast their votes in the manner provided for by-elections. According to section 91, the presiding officer (PO) will prepare a gender disaggregated statement of voters showing total number of men and women voters at the polling station and the total votes cast by males and females. He will send this statement to the returning officer (RO) and to the ECP at the time of communication of result to both. The PO may, at any stage on the polling day during or after the polling, prepare and send a special report to the RO and to the ECP if he has reason to believe that women voters have been restrained from exercising their right to vote based on any express or implied agreement. Another important provision relates to a scenario where the votes of two candidates turn out to be equal. Section 97 says where, after consolidation of the results of the count, there is equality of votes between two contestants, the RO will declare both the candidates as returned and each one of them will be entitled to represent his constituency for half of its term of office. The RO will draw in the presence of such contestants or their election agents a lot to determine as to which candidate serve for the first half term of office to be followed by the other. If, in case of death or any other cause one of the returned candidates fails to assume office or his seat becomes vacant, the other surviving returned candidate will serve for whole or remainder of the term. However, where there is equality of votes among more than two contesting candidates, the ECP will issue fresh election programme for the constituency and determine the date of polling day which shall not be later than sixty days from the date of consolidation of results. According to section 61, the RO will not accept a nomination paper unless a sum of Rs30,000 for election to a seat in the National Assembly and Rs20,000 for election to a seat in a provincial assembly is deposited by the candidate or by any person on his behalf in cash with the RO or through bank draft drawn in favour of the RO; or in cash in a specified account with any branch of the National Bank of Pakistan, receipt of which should be produced before the RO. Not more than one deposit will be required in the case of a person who has been nominated as a candidate by more than one nomination paper. After termination or conclusion of the election, a candidate may obtain return of the deposit. If a candidate, not being the returned candidate, obtains less than one-fourth of the total votes polled in the constituency, the sum deposited by him or on his behalf will stand forfeited in favour of the government.
