Asks CDA what it has been doing for so many years ISLAMABAD: The Supreme Court (SC) on Wednesday questioned what the Capital Development Authority (CDA) and Islamabad Capital Authority (ICT) had been doing while illegal construction continued in Banigala as the apex court observed that a single house constructed illegally could **t be demolished as all such buildings would have to be razed. A three-member bench of the apex court, headed by Chief Justice Mian Saqib Nisar, resumed hearing into the suo moto case taken on the complaint of PTI chief Imran Khan against the municipal lawlessness in Banigala. Chief Justice Mian Saqib Nisar, during the course of hearing, questioned as to why the CDA and ICT had failed to act against the illegal construction when they were being erected. The CDA, the other day in pursuance of the court’s order of April 24, submitted a report stating that 122 buildings, including the residence of Imran Khan, constructed either in Zone III or Zone IV, Banigala area, were in violation of the ICT Zoning Regulation 1992 and the same needed to be demolished. On Wednesday, an interesting development was witnessed when Advocate Syed Zafar Ali Shah submitted an application requesting to be a party in the instant case on behalf of some of the residents of Banigala. He informed the court that construction within the 2-kilometer radius of Rawal Dam was illegal under the law, adding that those buildings constructed within the 2-kilometer radius included Supreme Court building, the Prime Minister’s ****** and the Convention Centre. “These buildings should also be considered as illegal”, he requested and alleged that the officials of CDA used to take bribes for construction of buildings within 2-kilometer radius. The court however ruled that the bench would consider the application when it deemed necessary. Meanwhile, during the course of hearing Babar Awan appeared before the bench on behalf of PTI chief Imran Khan and expressed his reservations about a joint report of CDA and ICT, which was filed the other day. He said that the authorities breached confidentiality as the report submitted to the court was handed to the media beforehand. Ruling out the apprehension that the above mentioned joint report was against a particular person, Chief Justice Mian Saqib Nisar observed that the case should **t be taken as an action against someone. He further observed that the main issue was regarding sewerage and cutting of trees adding that clean water and air was necessary for human survival. Babar Awan contended that report had **t mentioned the complete picture adding that the report only mentioned the southern area of Banigala. He further contended that assistance could be sought from Google mapping and satellite pictures for accurate demarcation of Banigala. He, however, further contended that marriage halls were constructed on the land of CDA in Banigala. Meanwhile, counsel for CDA Sardar Aslam submitted before the court that the construction was started in Banigala in 1999 after Dr Qadeer Khan constructed his house adding that the bungalows worth billions of rupees were constructed without any permission and taxes. This area needed to be regulated, he contended. Later, the court directed the CDA to submit the complete data of 20 years regarding allotment of lands on the bank of Rawal Lake along with terms of reference. The court also asked CDA and ICT administration for supervising the exercise of preventing trees’ cutting in the areas of Botanical Garden, National Park to Korang Road and from Murree Road to Banigala. The court further directed both the authorities to apprise the court as to which law was prevalent at the time of construction in Banigala, which according to CDA and ICT were unauthorised. Similarly, the court sought proposal from CDA and ICT for managing the sewerage and refuse system in Banigala and Rawal Lake area.
