IHC allows PTI to be party in CDA-IMC dispute
 

ISLAMABAD: Justice Aamer Farooq of the Islamabad High Court (IHC) here on Thursday accepted applications of Pakistan Tehrik-i-Insaf (PTI), opposition members in the Islamabad Metropolitan Corporation (IMC) seeking to become a party, in a pending matter where CDA employees have challenged handing over of CDA employees and assets to IMC.

IHC bench accepting the applications sought reply from the respondents.Previously three employees of CDA on August 22 while **minating secretary Ministry of Law & Justice, Ministry of Capital Administration and Development Division (CADD), Ministry of Interior, IMC, Chairman CDA and Director General CDA as respondents, had challenged the decision of transferring 49 wings of CDA to the IMC.CDA employees Azhar Khan, Muhammad Nisar Akhtar and Syed Munawar Ali Shah have been praying to the court to set aside the **tifications dated 22 and 27

June, 2016 through which this transfer of around 10,000 employees of the civic body and assets were to be handed over to the IMC. CDA employees were claiming that this transfer was illegal.

In this recent move, PTI’s opposition leader in the IMC, Ali Nawaz Awan, and the chairman of the UC-35, Malik Muhammad Rafique applied before the IHC to become a party while contending that they are also stakeholders of this local government system first time introduced in Islamabad.

The petitioners contended that according to the provisions of the Islamabad Capital Territory Local Government Act, 2015, an interim and transitional period is still going on but practically the local government has **t yet been able to become functional due to technicalities regarding transfer of employees and assets from CDA to IMC.

PTI members of opposition adopted before the IHC that they were stakeholders of the IMC but are “handicapped” to perform their legitimate and lawful functions and duties as prescribed in the law. They prayed to the court to allow them becoming a party in this case.IHC bench while accepting their applications put off this matter till September 6.
