PESHAWAR: The opposition in the Khyber Pakhtunkhwa Assembly on Tuesday filed a **-confidence motion against Chief Minister Pervez Khattak to block a possible dissolution of the provincial legislature by the ruling Pakistan Tehreek-i-Insaf (PTI).

The move to bring the **-confidence resolution is interesting because it is meant to save the provincial assembly and secure the chief minister instead of toppling the Pervez Khattak-led coalition government. The **-confidence motion was precipitated by fears that PTI Chairman Imran Khan has made up his mind to order the dissolution of the assembly in an effort to build up pressure on Prime Minister Nawaz Sharif to step down.

Imran Khan and his supporters, in addition to Dr Tahirul Qadri, have converged on Islamabad to attempt to topple Nawaz Sharif’s government on the grounds of poll rigging in 2013. The PTI has already an**unced that its members from the National Assembly, Punjab Assembly and Sindh Assembly are resigning. The party debated the dissolution of the KP Assembly, where it enjoys a majority, but many in the party opposed it. The opposition parties in KP Assembly feared the decision could come any time and pre-empted it by filing a **-confidence motion against Pervez Khattak.

Under the Constitution of Pakistan, the chief minister can**t advise the gover**r to dissolve the assembly once a **-confidence move has been tabled.Opposition leader Maulana Lutfur Rahman and Mahmood Ahmad Khan Bhittani belonging to the Jamiat Ulema-i-Islam-Fazl (JUI-F), Qaumi Watan Party (QWP)’s Sikandar Sherpao, Pakistan People’s Party (PPP)’s Muhammad Ali Shah Bacha and Pakistan Muslim League-N (PML-N)’s Arbab Akbar Hayat submitted the motion to the provincial assembly secretariat.

KP Assembly Secretary Amanullah Khan confirmed the secretariat had received the **-confidence motion at 12-**on on Tuesday, signed by 46 members. Speaker Asad Qaiser said the **-confidence motion had been sent to the law department on Tuesday and **w it was up to the government to convene the assembly. He disputed the claim that the speaker has to summon the assembly meeting within 14 days. “I am bound to convene the session within 14 days when the opposition submits a requisition for an assembly meeting,” he argued.

JUI-F provincial President Maulana Gul Naseeb told a press conference here on Tuesday that the move was aimed at staving off the dissolution of the assembly. He said his party leader Maulana Fazlur Rahman had established contact with the Jamaat-e-Islami (JI) and Awami Jamhoori Ittehad Pakistan (AJIP), both coalition partners of the PTI, to seek their support for the **-confidence move against the chief minister.

The Awami National Party’s Sardar Hussain Babak said the opposition moved the **-confidence resolution to block PTI attempts to dissolve the KP Assembly. “This was the only constitutional way to save the assembly,” he said. “Our intention is **t getting power or unseating Pervez Khattak by bringing this motion. We are saving the assembly...and maybe the PTI government,” he added. He felt the PTI should **t dissolve the assembly.

Was the PTI about to take the decision to dissolve the KP Assembly that the opposition swiftly moved to preempt it? The opposition had got some ‘indications’ that such a decision was coming, said Sikandar Sherpao, the Qaumi Watan Party provincial president and parliamentary leader. He said the speaker had to convene the meeting within 14 days as the motion also served as a requisition.

While explaining the procedure, he said that after leave of grant by 26 members, the speaker would allow at least one day for debate on the **-confidence motion and then hold voting within a period **t exceeding seven days but also **t before three days.

Article 136 of the Constitution of Pakistan deals with **-confidence move against chief minister. “1[136. Vote of **-confidence against Chief Minister.-(1) A resolution for a vote of **-confidence moved by **t less than twenty per centum of the total membership of the Provincial Assembly may be passed against the Chief Minister by the Provincial Assembly.

“(2) A resolution referred to in clause (1) shall **t be voted upon before the expiration of three days, or later than seven days, from the day on which such resolution is moved in the Provincial Assembly.

“(3) If the resolution referred to in clause (1) is passed by a majority of the total membership of the Provincial Assembly, the Chief Minister shall cease to hold ******.],” it says.

Sikandar Sherpao said they had **t consulted Jamaat-e-Islami, the PTI coalition partner, before filing the motion. However, he said the opposition would hold talks to persuade it to support the motion.

JI chief Sirajul Haq told The News it was the opposition’s right to move the **-trust motion but his party would make decision whether to support or oppose it in its parliamentary party’s meeting today (Wednesday).

Senior Minister Inayatullah Khan, who belongs to JI, said it was part of the government and could **t support the **-confidence against it. “It’s clear that we are against the dissolution of the assembly. It’s also clear that we in the JI are **t going to tender resignations from the assembly,” he said, hurrying up to add that PTI had given his party assurances that it was **t going to dissolve the assembly. “You have to trust your allies’ words in a coalition government,” he said, when asked whether they had got assurances in writing.

Information Minister Mushtaq Ahmad Ghani scotched ‘rumours’ about the dissolution of the KP Assembly and termed the opposition’s act as ‘a wrong move.’ At this time, he claimed, the party had **t decided to dissolve the assembly. “Without taking our allies into confidence, we will **t dissolve the assembly,” Mushtaq Ghani told The News. “If the allies agree to dissolution, we will do it but if they oppose it we will **t dissolve it,” he explained.

He said Imran Khan and Chief Minister Pervez Khattak had categorically said that ** decision about the dissolution of the assembly had been taken.Asked whether the party was considering the option of resignation from KP Assembly instead of dissolving it, he did **t rule this out. “This can happen,” he said. Mushtaq Ghani said the **-confidence motion would fail. “How are they going to succeed when we have support of all our allies?” he stressed.
