ISLAMABAD: The Supreme Court on Friday rejected the government report on the Faizabad sit-in, describing it as incomplete and unsatisfactory, sought details of the action against the protesters and their leader Khadim Hussain Rizvi.
A two-member bench comprising Justice Mushir Alam and Justice Mazhar Alam Miankhel was hearing a case pertaining to the Faizabad sit-in that had paralysed the federal capital for over two weeks last year.
After going through the report submitted by the ISI, the court said the document didn?t mention many things.
It observed that the government-level dialogue held with the rioters encouraged them, with a belief that they could paralyse the citizens whenever they wanted to.
The court had neither been informed about the action taken against the protesters nor those from the government side responsible for negligence, the bench remarked.
Deputy Attorney General Sohail Mehmood said the Rizvi-led Tehreek-e-Ya Rasool Allah was a registered political party and being monitored. To which the court observed whether the head of a registered party could do anything.
Ordering the deputy attorney general to provide details within two days, the court also remarked that a total of 27 FIRs had been registered and 418 people arrested, but no record submitted. Justice Mushir said, ?Where is the state writ?? asking the officials to tell the court what legal action had so far been taken against Rizvi.
Justice Mazhar observed, ?What has been learnt from the protest? Will that happen again,? he asked the representatives of the government and security agencies who were present in the court.
Justice Mushir wondered if the government would treat anyone challenging its writ like it did in the case of the Faizabad sit-in. He asked Attorney General Ashtar Ausaf whether the protesters had not committed any crime under the Pakistan Penal Code (PPC), wasn?t any public property damaged or any police officer injured during the protest.
The protesters set off for Islamabad from Lahore but no one bothered to stop them there, he observed. ?Nor did anyone stop them at the Liaqat Bagh where they had camped out en route to Islamabad,? the judge noted.The attorney general informed the Supreme Court that the government had drafted Anti-riots Protection Act 2018 which aimed at handling protests in the country. The draft would be presented and discussed at a federal cabinet meeting scheduled to take place on Tuesday, he added. Further hearing of the case was later adjourned for two weeks.
