KARACHI: The Supreme Court on Saturday restrained four packed milk companies from further production and sale after their samples were found unsafe for human consumption following tests from the Pakistan Council of Scientific and Industrial Research laboratories.

Hearing a suo moto case regarding deficiencies in the production, processing and packing of different brands of packed milk in Sindh, Supreme Court?s three member bench headed by Chief Justice Mian Saqib Nisar was informed by member of Commission Mohammad Vowda that four packed milk companies out of 50 were found to be unfit for human consumption. The court, issued notices to the manufacturers of the packed milk companies and restrained them from further manufacturing and sale till further orders. The court also directed them to withdraw their stock from markets warning of strict action in case of non-compliance.

Medical hospitals: The Supreme Court directed all the medical superintendents of the Karachi hospitals to submit their affidavits with regard to availability of medical facilities in their hospitals within 10 days. Hearing suo moto proceedings on plight of the government hospitals, the three member bench headed by Chief Justice Mian Saqib Nisar observed that hospitals and medical colleges should produce competent doctors instead of quacks. The CJP observed that it was painful when one senior doctor informed him that many new doctors did not even know how to measure the blood pressure.

The court directed the deputy executive director of Jinnah Postgraduate Medical Centre to submit a written statement with regard to problems after devolution of JPMC and other affiliated hospitals.

The court observed that all the institutions are bound by the Constitution and the court will first examine the legal issues of the devolution of JPMC and other affiliated hospitals and then take up other relevant issues. The court observed that courts were performing their constitutional duty and were not overstepping in jurisdiction of the other institutions in the name of judicial activism. The Chief Justice observed that the Parliament is supreme but all decisions have to be taken under the Constitution.

The court directed medical superintendents of hospitals to submit affidavits regarding equipment, emergency machinery including ventilators, oxygen, incubators, OTs facility, angiography machines, CT Scan, MRI, ambulances, etc as well as explain the position as to the availability of life saving drugs and the medicines being provided to the patients free of cost and those which they have to purchase.

The Chief Justice further sought the details to the availability of qualified doctors and nursing staff and directed all the medical superintendents of the government hospitals to be present along with detailed reports reflecting the position of respective hospitals on the next hearing. The court observed that in case of non-compliance the delinquent medical superintendents will have to face the proceedings for disobeying the court orders.

Regarding the admission criteria in private medical colleges in Sindh, the court observed that any admissions in private medical colleges shall be subject to final decision of the court and directed the Pakistan Medical and Dental Council not to recognize further admissions in private medical colleges.

Meanwhile, the Supreme Court dismissed review applications of Sindh government about dissolution of Sindh Solid Waste Management Board (SSWMB) and winding up of the North Sindh Urban Services Corporation (NSUSC), a company financed by the Asian Development Bank for water supply and waste management for the eight cities of Sindh.

Hearing identical petitions against lack of water supply and environmental pollution in the city harbour and coastal areas being poisoned due to release of industrial waste, SC three member bench headed by Chief Justice Mian Saqib Nisar observed that Sindh Solid Waste Management Board was constituted only to hold money and it has served no other purpose. The court observed that the industrial and municipal waste were being discharged in water and the commission also found bodies of animals at water supply schemes in Hyderabad.

The Chief Justice asked Mayor Karachi to work together for the improvement of the Karachi irrespective of political differences and assured court's support to the administration to resolve the problems of water and sewerage related issues.

Justice Gulzar Ahmed observed that government is not willing to resolve the problems of the citizens and no institution is working properly in Sindh. The Chief Justice observed that the judiciary will get rid the people of Karachi from water tankers mafia. The Chief Justice directed Pakistan Council of Scientific and Industrial Research?s officer to carryout laboratory test of Nestle water company bottle and submit report within four days.
