KARACHI: The Supreme Court has ordered removal of more than 35,000 encroachments and illegal constructions from amenity plots across the metropolis within two months, stressing that no one would be allowed to play havoc with the city. The SC?s two-member bench headed by Justice Gulzar Ahmed issued the directives to the Karachi Development Authority (KDA) and Karachi Metropolitan Corporation (KMC) on Wednesday on the petition of one Sabiha Parveen.
Hearing her plea against non-compliance of court orders, the bench asked the director general of KDA how amenity plots across the metropolis were allowed to be encroached and why no action had been taken against the illegal constructions.
Does anyone realise or feel shame over the situation, he asked. The KDA chief submitted a progress report claiming that encroachments and illegal constructions, including marriage halls, had been removed from 27 places across the city. He informed the court that more than 35,000 amenity plots across the metropolis had been encroached or had illegal constructions. The bench said the entire city had been destroyed due to China-cutting and encroachments, and directed the KDA to submit the details of amenity plots across the metropolis along with their master plans. The court said footpaths had also been encroached by makeshift shops.
The KDA official told the court that illegal allotments of amenity plots were allowed after amendments in the relevant laws in 1992 and that master plans were amended in 1953, 1965, 1974, 1985 and 2000.
The court said Karachi looked like a European city in the past and people used to visit it in droves, adding that the metropolis was last cleared of encroachments in Ayub Khan?s era, but now it had turned into a rubbish dump.
The bench directed the KDA, KMC and relevant deputy commissioners to cancel all allotments and illegal encroachments on amenity plots and remove them within two months. The court also directed the KDA to submit a report with regard to construction of a wall in front of the Mohatta Palace.
Meanwhile, according to the petitioner, the court had ordered to allot her a plot in North Karachi?s Sector 11-A, but the KDA gave the plot to someone else and allotted her an amenity plot.
