RAWALPINDI: The Chief Justice (CJ) of the Lahore High Court (LHC), Justice Mansoor Ali Shah, on Saturday constituted a reforms committee, comprising presidents of bar associations of 36 district, for providing speedy justice and to check malfunctioning of judicial system.

“Our objective is immediate dispensation of justice. For this, bar and bench needs to be on the same page. To achieve this homogeneity there is a need of meaningful dialogue between bar and the bench as both are part and parcel of the justice system. If there will be reforms at the bench and **t at the bar, judicial system can**t function effectively,” the LHC CJ said, while addressing a ceremony at the Lahore High Court Bar Association (LHCBA), Rawalpindi Bench.

It has become a cliché that judiciary is **t working. Cases keep pending year after year. This impression needs to be changed **w, he said.

“When media and civil society criticise judicial system this reprove is **t for the bench alone but the bar also shares this. I am forming a reform committee comprising presidents of the bar associations and we will hold a dialogue to search our souls to see root causes for the malfunctioning of judicial system.

“I feel there is a disconnect between bar associations of the province. Sometime a delegation of a tehsil bar council comes to me with a particular problem while the district bar remains unaware. Sometime district bar comes to me and relevant high court bar has ** k**wledge of it. And sometime high court bar comes to meet me and Punjab & Pakistan bar council remains uninformed,” he said.

“This should be rectified and we need to evolve a mechanism to uproot this disconnect,” he said.

Prior to his address, the LHC CJ inaugurated an e-library set up for the lawyers to research on legal issues. Justice Mansoor Ali Shah particularly laid stress on the use of information tech**logy and said that IT has brought a significant change to our environment.

“Coming days, there may be ** files and everything may be through computers. We are forwarding toward paperless future and that is even better for the environment as less trees will consumed in paper industry,” he said. The LHC CJ pledged that soon there will be e-libraries at the 88 Tehsil Bar Association, 36 district bar associations and 4 high court bar associations.

Justice Shah stressed that young lawyers should do extensive research on jurisprudence. Apart from Pakistan they should also see jurisprudence of India, the UK, Australia and other countries. A lawyer with good k**wledge can better assist the court. As a lawyer our power is k**wledge and reason. Increase in k**wledge will better arguments of a lawyer and decision of a judge.

Bar and bench are cordial part of justice system. Lawyers and judge jointly produce the jurisprudence. Reforms in the bench alone, can**t bring change, unless bar councils are **t reformed.

“Two years back Punjab government had offered to us that they want to bring efficacy to the judicial system through IT enterprise solution case management system. It was a system in use at international level. We could **t tailor that international system according to our judicial mechanism, so we adapt that system and tailored our judicial system accordingly. **w everything is computerised in that system and there will be more in**vations in coming future,” Justice Shah said.

“Our primary concern is swift adjudication of the cases and with reforms in the bench we have to see, if we are **t dispensing justice effectively, that may be due to our own issues and internal politics. For justice system to function, bar and bench needs to be on the same page” he added.

Before that senior LHC judge, Justice Sadaqat Ali Khan addressing the lawyers, shed light, on the salient features of enterprise solution case management system. He said that in previous system, stay orders use to go for years and years on. Everybody used to try and obtain a stay order because he could keep using this for long time. Through this new enterprise system, **w there is **t even a single case whose date of hearing is **t fixed. Through this system, **w institution of the case is less and adjudication is more. At the LHC all appeals pertaining to bomb blasts have gone decided and **t a single one is pending. Alternate Dispute Resolution (ADR) system is working and model courts deciding cases in weeks and days. At Rawalpindi bench nearly all murder references got decided, Sadaqat Ali Khan said.

LHCBA President Zafar Mughal said that some quarters were criticising the judiciary. Bar and bench would jointly defend this criticism, he also said.
