ISLAMABAD: A judge of the Islamabad High Court (IHC) has expressed resentment against the Pakistan Broadcasters Association (PBA) for misrepresenting the case regarding the Pemra guidelines for TV channels in his absence before a**ther IHC bench that granted relief to the petitioner.
Aggrieved by an order passed by Justice Athar Minallah of the same court, Justice Shaukat Aziz Siddiqui has referred the matter to the Supreme Court.Justice Shaukat Aziz Siddiqui attended the court on June 5 on the Supreme Court directions while cancelling his leave but the PBA counsel did **t appear before the court.
When Justice Siddiqui went to Saudi Arabia to perform Umra, the PBA moved a civil miscellaneous (CM) application in the court of Justice Athar Minallah who granted relief to the petitioner on June 15 while observing, “The petitioners or any other member of the general public, if aggrieved in relation to any aspect(s) of a programme broadcast by the electronic media shall be at liberty to exercise the right vested under Section 26 of the ordinance of 2002.
In case such a representation or an application is received then this court expects that it shall be conceded and decided by the competent forum preferably within one week. The authority (Pemra) as a statutory regulator is expected to perform its functions in accordance with the law having regard to the fundamental rights guaranteed under the constitution”.
Justice Athar Minallah in his order further said: “This order has been passed pursuant to the direction of the august Supreme Court vide order dated 31-05-2017, passed in civil petition **, 1737/2017. Consequently, all other interim orders passed in the instant petitions stand abated”.
Expressing his resentment over the order of Justice Athar Minallah, IHC Justice Siddiqui said, “I observe with great concern that despite the fact that I mentioned the order of august Supreme Court of Pakistan in my order dated 05-06-2017, my learned brother passed the order on CM which in fact frustrated the order dated 05-06-2017. The mannerism in which the above CM was moved and decided is **t less than an abuse of the process of law, an attempt to achieve desired results by avoiding particular bench.”
