ISLAMABAD: The Pakistan Tehreek-e- Insaf (PTI) has come up with a challenge to the perception that the case against its chief, Imran Khan, in the Supreme Court has stark similarities with the case against the ruling PML-N chief Nawaz Sharif and his family pending before the apex court and being probed by a JIT.

The PTI has declared that cases against two leaders can**t be compared in any way as the PTI chief never held any public ****** and all the points raised in the case against Imran Khan are entirely different from the very strong allegations against Prime Minister Nawaz and his family.

A PTI rejoinder on the issue says: “The similarities being drawn between the case against the Prime Minister by Imran Khan and that against him subsequently filed by Hanif Abbassi in the Supreme Court with regard to matters involving offshore companies and undeclared foreign assets are **t only misconceived but part of a concerted campaign to mislead public by presenting out of context facts, which are also contrary to the actual proceedings in the Supreme Court.”

“The principal difference between the issues involved in the two cases is that all of five Ho**urable Judges of the Supreme Court did **t believe the prime minister’s or his children’s explanation of the source of funds, purchase and ultimate beneficial ownership of the Mayfair apartments during periods that he was holding high public ******. The Supreme Court, therefore, constituted a JIT to investigate into the questions framed by it which process is ongoing.

“Imran Khan, on the other hand, has explained through banking and other official documents dating back to the purchase of his London apartment that he voluntarily liquidated his foreign-source, **n-resident, tax paid earnings and caused for these to be remitted to Pakistan through official banking channels. He then used these funds to purchase land to construct the family residence. Imran Khan was **t holding any high executive ****** at any time during this period.

“Imran Khan is **t under investigation by a JIT for possibly beneficially owning undeclared off-shore assets through his children beyond his declared sources of income whilst holding public ******.

“Imran Khan has produced documentary evidence showing: that Niazi Services Limited (NSL) owned ** property other than the declared apartment; evidence of the net amount of sale proceeds, confirmation from the relevant financial institution that Imran Khan issued banking instructions for repaying the temporary loan from his wife, full banking trail of receipt of funds into the bank account of Rashid Khan, conversion of those funds to rupees by the State Bank, copies of all bank drafts in favour of the seller of the Banigala land and his confirmation of receipt of the total purchase price. The comparison with the documentary evidence produced by the prime minister before the Supreme Court to prove his claimed version of events is startling but ig**red.

“The Supreme Court for its further satisfaction has asked for the remitters name on a handful of remittances from Jemima Khan to Rashid Khan’s account. The record for these remittances dating back to March – October 2002 was with Citibank, Pakistan, where Rashid Khan’s account was maintained. Citibank has shut down commercial operations in Pakistan. Enquires have revealed that the bank does **t maintain records beyond six years. However, banking documents from Jemima’s personal record have **w been located, which shall be duly presented before the apex court for the scrutiny.

“Against the above position, the prime minister has produced the Qatari letter as evidence of his ‘paper trial’ of transfer of funds which was unanimously disbelieved and rejected by all five Ho**urable Judges of the Supreme Court.

“The comparison between the offshore companies Nescoll and Nielsen on the one hand, and NSL on the other ig**res the crucial fact that to-date the ultimate beneficial ownership of Nescoll and Nielsen on the date of the purchase of the Mayfair apartments in the early 1990s has never been disclosed. Imran Khan on the other hand has disclosed the entire record of NSL and admitted beneficial ownership of his London apartment through NSL. He has also given an explanation for placing the apartment under NSL. The prime minister is yet to convince the nation that he and his family did **t beneficially own Nescoll, Nielsen and the Mayfair apartments since inception in the 1990s.

“The comparison being drawn between the Qatari letter and the role of Rashid Khan in the case of Imran Khan is also mistaken. Contrary to the impression being created Rashid Khan has **t been introduced into the case during the proceedings of the Supreme Court. In all proceedings before the Election Commission and elsewhere Imran Khan has produced the same set of documents which disclose the role of Rashid Khan. Even more significantly, Rashid Khan has **t only sworn an affidavit, along with the previously submitted copies of all proceeds, realisation certificates, pay-orders and receipts but has been present personally in the Supreme Court to respond to any queries of the Ho**urable Bench on his affidavit. The Ho**urable Supreme Court was informed of his presence. On the other hand, the Qatari letter is just that -- a ‘letter’ -- **t an affidavit, which contains mere hearsay as the author is merely narrating matters on which he can**t give evidence. The Qatari gentleman has neither presented himself before the Supreme Court **r before the JIT in spite of two summons.

“Again, the Qatari letter is designed to explain the ownership and purchase of hidden offshore assets. Rashid Khan’s affidavit and related documents by Imran Khan are evidence of a citizen bringing back to Pakistan his lawfully earned income and declaring all of it. **t only that when the Banigala property was purchased and transferred both times full stamp duty and other taxes were paid. The comparisons are, therefore, **t warranted.”
