Custodial torture of accused
PESHAWAR: The police investigation has recommended to the prosecution department to exonerate director general (DG) NAB Khyber Pakhtunkhwa from the first information report registered against him and the investigation ******r of NAB for allegedly torturing an accused in custody.
As per the police investigation report, it was recommended that it will be better to place Umar Butt, investigation ******r NAB, in column number 2 of challan form, and DG NAB Khyber Pakhtunkhwa Shehzad Saleem may be exonerated from the charges as ** sufficient and cogent evidence was provided by Sardar Gul Khitab, the accused who claimed to have been severely tortured during custody.
The investigation team has concluded that the NAB investigators are charged for beating the accused while he was in their custody. “It was minutely probed and decided. Dr Ataullah in his medical report has clearly opined that bruises are present on various parts of the body of Sardar Gul Khitab. However, this DG NAB and investigation ******r can**t be held responsible that the bruises on his body were caused due to torture at their hands as these may be self-inflicted,” the report stated. It added that the accused has tried to get the sympathies of the courts by making charges against the NAB authorities to save his skin and to get himself reinstated in the NAB.
In summary of the statements during investigation, it was stated that the complainant Saiqa Gul Khitab, daughter of the accused Sardar Gul Khitab, made an appeal against the dismissal of her application under section 22 of CrPC in the Peshawar High Court. It said the PHC accepted the appeal and ordered registration of FIR against the DG NAB KP and the investigation ******r within three days.
“A proper case was registered on May 16, 2016 under sections 337-K/337-A(1), 506/34 of Pakistan Penal Code (PPC) in Hayatabad Police Station,” the report said, adding that Saiqa Gul Khitab complained that the NAB arrested her father on April 30 and the DG NAB ordered the investigation ******r to beat him till his confession in the case. She alleged that the DG NAB even authorised the investigation ******r to beat him to death.
However, the DG NAB in his statement before the examination team stated that he never visited the interrogation session. He insisted that Sardar Gul Khitab being an employee of the NAB was involved in corruption and corrupt practices. He stated that being a responsible ******r, he never issued or conveyed any orders to investigation ******r to beat or harass the accused.”
On July 14, the PHC had received an application seeking implementation of the first information report (FIR) registered against National Accountability Bureau (NAB) officials for allegedly torturing an accused in custody.
Saiqa Gul Khitab in her application sought action on the FIR lodged against the NAB KP Director General Shehzad Saleem and Investigation ******r Muhammad Umair Butt.According to her application, the police registered the FIR to comply with the court order, but ** action was taken against the DG NAB and the other ******r.
“We want justice and action against the officials as per the law,” she requested the PHC chief justice in the application.On May 11, a PHC division bench comprising Justice Waqar Ahmad Seth and Justice Musarrat Hilali allowed the writ petition and ordered registration of the FIR against the DG NAB and investigation ******r Umair Butt.
The suspect Sardar Gul Khitab was arrested by the NAB on April 30. An accountability court remanded him into NAB’s custody for seven days. The NAB alleged that he had received bribe of Rs200,000 from a municipal ******r, Mehboob Ali, in Abbottabad by impersonating as NAB KP assistant director (investigation) Umair Butt.
