ISLAMABAD: High-pitched sound and fury and exchange of hot words between some leaders of the federal and Sindh governments apart, the two **tifications issued by the interior ministry plainly bespeak extension of special policing powers of the Rangers to the Karachi division only and **t the whole of this province as was generally hyped and believed.

These proclamations are exactly the same that had been issued by the federal government for several times in the past since the paramilitary force, Rangers, was given the distinctive powers under the Anti-Terrorism Act (ATA).

One **tification stated that the powers conferred on the Rangers in the Karachi division under clause 1 of sub-section 4 of the ATA are extended for a**ther period of 90 days with effective from July 20. This left ** ambiguity about the exercise of special powers by the Rangers in Karachi division alone.

The other **tification was issued under article 147 of the Constitution to entrust duty/function to the Rangers under this provision. It only spoke about the “deployment” of Rangers in the entire Sindh province to assist provincial police in maintaining law and order but did **t arm the paramilitary force with special powers like those under the ATA for the Karachi division.

Article 47 provides for the power of the provinces to entrust functions to the Federation and says **twithstanding anything contained in the Constitution, a provincial government may, with the consent of the federal government, entrust, either conditionally or unconditionally, to the federal government, or to its ******rs, functions in relation to any matter to which the executive authority of the province extends. Such a provincial government will get the functions so entrusted ratified by the provincial assembly within sixty days.

Its reading makes it clear that the decision to entrust certain functions to the central government through any of the institutions under the latter’s control is to be taken by the concerned provincial administration with the consent of federal authorities.

These **tifications have obviously satisfied the Sindh government, which had been insistent that the interior ministry could **t and should **t sidestep the precise request it had sent. Minister Nisar Khuhro rightly articulated it when he stated that it was evident from the acceptance of the provincial summary that the provincial government had decided to give powers to the Rangers as per the Constitution. “The paramilitary force is here for years and will remain here in future as well. It has been given special powers to maintain better condition in Pakistan’s gateway, Karachi.”

In view of the contents of these orders, the hullabaloo raised over the issue in which some leaders of the federal and Sindh government actively participated was inconsequential, having **thing to do with the reality. The federal government absolutely accepted the request and did **t do anything that was **t in consonance with the summary of the provincial administration.

The row was apparently part of politics of the federal and provincial governments, which is mostly witnessed every time the Rangers’ policing powers are to be extended after every three months. The interior ministry acted sensibly by **t digressing from the recommendations of the Sindh government.

The second order stated that the competent authority has accorded approval for deployment of Rangers with effective from July 20, 2016 to July 19, 2017 to continue to discharge functions as per the law and for rendering assistance to the Sindh police in maintenance of law and order in with the Sindh province. The stay or deployment of the Rangers in Sindh was proposed by the provincial government for a**ther year that the interior ministry approved as it is.

It will be a different story that the Rangers, acting under the second **tification, may undertake operations in the interior parts of Sindh. However, as per the proclamation the paramilitary force is required to only assist the provincial police and **t operate independently. Additionally, it doesn’t have the special powers under the ATA for the entire Sindh province.
