ISLAMABAD: The Capital Development Authority (CDA) here Wednesday in response to a petition of a private builder BNP Group submitted reply before the Islamabad High Court (IHC) where it narrated an account of favours by the civic body to the builder.

The reply tells how lease of land was extended from 33 years to 99 years, how permission for the construction of 120 flats turned into construction of 240 flats and how the lease amount was rescheduled for a 13.5 acre plot at Constitution Avenue.

A private builder BNP had filed petition before the IHC where it challenged sealing of its high-rise that had residential apartments in it. CDA in its reply described certain facts and the CDA Chairman Maroof Afzal signed the reply.

It says that the CDA on May 22, 2004 through an advertisement invited applications from interested parties for the lease of a 13.5 acre land where a 6-story residential building had to be constructed. The CDA wanted to lease out this land for 33 years. After pre-qualification of 9 firms, CDA cancelled the auction and published a**ther advertisement where height of building was relaxed from 6 stories. The period of lease was extended from 33 years to 99 years.

In previous advertisement, possession of land had to be given to the successful bidder after full payment of the lease amount but in new ad, successful bidder was offered 15 percent of the total amount to deposit and get possession of the plot.

On March 9, 2005, plot was auctioned to BNP Group against Rs4.88 billion where successful bidder deposited 15 percent of the amount that was Rs400 million. Rest of the amount was payable within 15 years.

Reply further says that CDA former chairman Tahir Shahbaz in 2012 rescheduled the payment plan and allowed BNP to pay remaining amount till 2026.

The CDA in its reply has highlighted violations of the building plan and says “construction of a hotel, which was an integral part of the project has **t started yet.” Building plan was valid from 2008 to 2013 but it was **t re-validated and without obtaining completion certificate BNP sold out the apartments. Reply also pointed out that BNP had constructed 240 apartments where as it was permitted to construct 120 only.
