ISLAMABAD: The government and the opposition on Tuesday agreed to appoint members of the Election Commission before the expiry of constitutional deadline of July 25 and decided to exchange names of members on Thursday.
Finance Minister Senator Ishaq Dar held a meeting with the Opposition Leader in the National Assembly Syed Khursheed Shah in the Parliament House for consultation on the appointment of members and the revival of the Parliamentary Committee for the formulation of Terms of References for probing the PanamaLeaks.
Finance Minister Senator Ishaq Dar, during the meeting, conveyed the message of Prime Minister Nawaz Sharif and assured him that the government is willing to settle all the issues with the opposition through dialogue and consensus.
The finance minister assured the opposition leader that the government will **t hesitate to make the opposition’s **minations at the vacant posts of the members of the Election Commission of Pakistan if they brought credible and reputed names.
During the meeting, Khursheed Shah sought time from the government for the appointment of members due to the meeting of opposition parties on Wednesday.Both the leaders agreed to share names of new members with each other in the next meeting, which is scheduled to be held on Thursday.
Finance Minister Senator Ishaq Dar said appointments of members of the Election Commission will be made within the stipulated time of 45 days.Opposition leader Syed Khursheed Shah said that consultation with all the opposition parties was underway in this regard.
After the meeting when the journalists waiting for the outcome of the meeting between Finance Minister Senator Ishaq Dar and Opposition leader Syed Khursheed Shah asked about the names of government **minees for the posts of members of the Election Commission of Pakistan, Finance Minister Ishaq Dar refused to divulge the names and restricted himself to saying that, “We will able to make the appointment of members of the Election Commission of Pakistan before the expiry of the constitutional deadline of 45-days.”
It may be mentioned here that after the ECP was rendered incomplete with the retirement of its four members on June 12, the electoral process has been in limbo across the country, including mayoral or deputy mayoral elections, by-polls in various constituencies and **tification of newly-elected parliamentarians.
According to the Constitution, the government and the opposition are bound to appoint ECP’s members within 45 days after their retirement.Due to the **n-appointment of the new members, the Election Commission could **t hold by-elections in 10 constituencies and local government elections in 22 constituencies of the country.
It may be mentioned here that Information Minister Senator Pervaiz Rashid has been elected as chairman of the 12-member Parliamentary Committee on appointment of the Chief Election Commissioner and members of the Election Commission.
The Election Commission of Pakistan has been dysfunctional with the retirement of its four members and **w the appointment would be made on the basis of 22nd Constitutional Amendment, which was recently passed by parliament and assent given by President Mam**on Hussain, under which bureaucrats and tech**crats besides retired judges of the superior courts would also be eligible for being members of the Election Commission of Pakistan as well as the Chief Election Commissioner.
Under the constitutional procedure of appointment of members of the Election Commission of Pakistan, the prime minister, in consultation with the opposition leader in the National Assembly, is required to forward three names for appointment to every vacant position of ECP member “to a parliamentary committee for hearing and confirmation of any one person”.
In case, there is ** consensus between the prime minister and the opposition leader, each of them shall forward separate lists to the parliamentary committee for consideration and confirmation of any one individual.
The 22nd Constitutional Amendment envisages a retired judge of the High Court or a senior bureaucrat or a tech**crat to be considered for appointment as a member of the Election Commission. Previously, only retired judges of the Supreme Court of Pakistan and high courts were eligible to become CEC and members of the ECP respectively.
According to the 22nd Constitutional Amendment, in case there was ** consensus between the prime minister and the leader of the opposition over the appointment of chief election commissioner, then both of them would send separate lists to the parliamentary committee for consideration and the committee would approve one of them.
If the prime minister and the leader of the opposition fail to agree over a candidate, they could dis***** their recommendations separately to the parliamentary committee, which would have the final say in the matter.The amendment provides that one member of the commission would be taken from each province. As a one-time exercise, two members of the commission shall stand retired after two-and-a-half years while the other two would retire after the next two-and-a-half years. An amendment in Article 222 of the Constitution provides that the powers of the Election Commission would be extended to include delimitation of constituencies of local governments.
