ISLAMABAD: Deep political polarisation has made the job of Prime Minister Nawaz Sharif and leader of the Opposition in the National Assembly, Syed Khursheed Shah, tough to meet the constitutional deadline of July 25 to appoint four members of the Election Commission of Pakistan (ECP).

As per the 22nd constitutional amendment, approved by parliament early last month, a vacancy in the ****** of an ECP member or the chief election commissioner (CEC) “shall be filled within 45 days.” The positions of the ECP members fell vacant on June 10 with the retirement of the four incumbents. Thus, the timeline to fill their slots will expire on July 25.

There is ** likelihood of any contacts between the two sides in the next 10 days because of the protracted suspension of all activities due to Eidul Fitr holidays. The **rmal business will start on July 11 after which only two weeks be left for expiration of the cutoff date.

A couple of weeks ago, preliminary discussions were held for **mination of the new ECP members after a parliamentary committee as specified by the Constitution was formed. Information Minister Pervaiz Rashid was elected its chairman.

Under the Constitution, only the premier and the opposition leader, being the consultees, have the exclusive role in the selection of the ECP members. But every opposition party wants its favourite **minees to be inducted.

Senior Pakistan Tehreek-e-Insaf (PTI) leader Dr Arif Alvi has stated that his party has communicated to Khursheed Shah the name of the election commissioner (member) for Sindh.

Top Pakistan Muslim League-Q (PML-Q) leader Chaudhry Pervez Elahi has repeatedly alleged that efforts are being made to stuff the ECP with PML-N cronies and demanded that his party must also be consulted in the appointment of the ECP members.

To hammer out a national consensus, both the government and Khursheed Shah want to take all the opposition parties on board so that **ne of them raises even a mi**r controversy over these appointments.

But even if such a consensus was reached at all, it may turn out to be useless and **t good e**ugh to forestall a subsequent deafening row if past is any guide. There was an unprecedented across-the-board national agreement on Fakhruddin G Ebrahim’s selection as the CEC, but the way he was slandered and slurred after the PTI lost the 2013 general elections, is k**wn to all and sundry.

Unless all the PTI’s recommendations for the ECP members will be accepted, it will always remain a restive and impatient force, always prone to create political instability.

Given the kind of bonhomie prevailing between the PTI and Pakistan People’s Party (PPP) for some time **w, they will hold close consultations in this connection and may reach consensus on the names.

In case the two consultees did **t agree on the four names, one from every province, they will send their separate lists to the parliamentary committee to take a final decision.

The present **minations are very important for all political parties because these ECP members will supervise the 2018 general elections. The ECP became dysfunctional immediately after the retirement of the members. As a result, the scheduled federal and provincial by-polls and election to different tiers of local councils have to be cancelled due to imperfect ECP. The 22nd amendment was passed to remove the apprehensions of some opposition parties in the procedure for appointment of the ECP members.

**w, even all the four ECP members and the CEC could be either tech**crats or former senior civil servants. Tech**crat has been defined as a person, who is the holder of a degree requiring conclusion of at least 16 years of education, recognised by the Higher Education Commission and has at least 20 years of experience, including a record of achievements at the national or international level.

For the first term of ****** of the four ECP members, the ECP will draw a lot as to which two of them will retire first after two and a half years. The posts of the two members, who will retire as a result of the draw, will be quickly filled.

The term of ****** of a member appointed to fill a casual vacancy will be the unexpired tenure of ****** whose vacancy he has filled. This method has been applied to ensure continuity so that the ECP doesn’t become totally vacant with the simultaneous retirement of all the members.
