Payment of Steel Mills workers’ salaries

ISLAMABAD: The Supreme Court on Friday reserved the judgment over maintainability of a petition, seeking direction to the government for payment of salaries to workers of Pakistan Steel Mills Corporation (PSMC).

A two-member bench of the apex court headed by Justice Ejaz Afzal Khan resumed preliminary hearing of a petition filed by Pakistan Steel Peoples Workers Union (CBA) through its chairman.

Filed under Article 184(3) of the Constitution, the petitioners made the federal government, Finance Ministry, Privatisation Commission, Sui Southern Gas Company and PSMC as respondents, prayed to direct the government to pay the gross salaries of the employees of PSMC which are **t being paid for the past six months as per the ECC decision dated 24-04-2014.

The petition further prayed the court to direct the government and PMSC to settle all their liabilities towards the provident and gratuity funds and replenish the same by depositing outstanding and current monthly contributions and repaying the outstanding loan and relevant mark up into the said funds.

Justice Ejaz Afzal observed that jurisdiction for hearing under Article 184(3) has limits. However, following the preliminary hearing, the court reserved the judgment over maintainability of petition seeking orders of the government pertaining to payment of salaries to employees and continuing the function of PSMC.

During the hearing, Justice Ejaz Afzal observed that the judiciary has been changed after 2014. He said the judiciary is strictly following the law and Constitution while a single step could drop down the institution.

Barrister Ali Zafar, counsel for CBA, informed the court that the government is destroying the Steel Mills as it has refused and failed to implement the decision of ECC dated 24/04/2014 in which a final plan was decided to be implemented which will enable the PSMC to achieve 77 percent of capacity utilisation.

He further told the court that the government has **t paid the salaries of employees for the last six months while dues of retired employees have also **t been paid leaving them so destitute that they can**t make any demands regarding the shutting down of PSMC. He added the government even stole the money from the provident and gratuity funds, belonging to the employees of the PSMC.

He said the government and Sui Southern Gas Company have connived together to stop the gas supply to PSMC and hence shut down the operations of PSMC, thereby directly damaging its plant and machinery worth billions of rupees.

He requested the court to direct the government for **t terminating or laying off PSMC employees or deducting the allowance or to change the terms and conditions of their service in any manner through this garb of making PSMC **n-functional.

Justice Qazi Faiz Isa, a**ther member of the bench, said the matter of paying salaries relates to the government, adding that even if they pass an order in this regard and the government don’t pay the salaries then what can they do.
