ISLAMABAD: The references of the Pakistan People’s Party (PPP) and Pakistan Tehreek-e-Insaf (PTI), seeking disqualification of Prime Minister Nawaz Sharif and other key figures, will lie unattended for quite some time in the Election Commission of Pakistan (ECP) because of its being constitutionally imperfect.
Unless the posts of four ECP members that fell vacant on June 10 due to the simultaneous retirement of all the incumbents are filled up, the ECP will remain incomplete, unable to perform its legal and constitutional functions. Immediately after the ECP members went home, all the work like by-polls and local elections that the ECP was supposed to organize was instantly halted because it can’t be done in their absence and by a defective ECP.
** proceedings are expected on the disqualification references submitted by the PTI and yet to be filed by the PPP for over a month or even more, till the appointment of the new ECP members.
Finance Minister Senator Ishaq Dar has discussed the issue with leader of opposition Syed Khursheed Shah to conclude the process of picking up the new members in 45 days or even before. A bipartisan parliamentary committee, headed by Information Minister Pervez Rashid, has been put in place to take into consideration the recommendations sent by the prime minister and the opposition leader.
Although the ECP members, who, in PTI Chairman Imran Khan’s opinion, were “dishonest and partisan” against his party and in favour of the Pakistan Muslim League-Nawaz (PML-N), are gone, he repeated his charge against the ECP as a whole on Friday, saying it was an ECP of PML-N. He accused that the ECP has played a terrible role (in general elections) and even failed to implement 40 recommendations of the judicial commission that had inquired into his electoral rigging charges.
“Still I am testing the ECP once again although the disqualification reference against the prime minister and other members of the Sharif family presents an open-and-shut case,” the PTI chief said.
However, he has always reposed full confidence in Chief Election Commissioner (CEC) Justice (retd) Sardar Muhammad Raza, who is **w the only constitutional appointee left in the ECP after the retirement of the ECP members.
In the presence of an incomplete ECP, concrete proceedings on any references would be open to serious questions. In 2011 the Supreme Court had suspended 28 federal and provincial lawmakers, who had returned in the by-elections, when an incomplete ECP existed.
While hearing a petition filed by Imran Khan against bogus electoral rolls, a three-member bench had also taken up the legality of by-polls held by the ECP when it was **t constituted as required under the newly passed 18th amendment.
Finally, on the court direction the government had to pass 20th constitutional amendment to validate at least 28 by-elections held over the past two years. The membership of these legislators had been suspended by the court because the by-polls had been held without completing the ECP in accordance with the 18th Amendment approved in April 2010.
The present **minations of the ECP members will be very important for all political parties because they will supervise the 2018 general elections.
To provide for a new procedure for their appointment, the parliament unanimously passed 22nd constitutional amendment last month. It was approved to remove apprehensions of some opposition parties in the prevailing procedure of **mination of the CEC and ECP members.
For the first time in Pakistan’s history, according to 22nd amendment, even a tech**crat can be appointed as CEC or ECP member. Tech**crat has been defined as a person, who is the holder of a degree requiring conclusion of at least sixteen years of education, recognized by the Higher Education Commission, and has at least twenty years of experience including a record of achievements at the national or international level.
