An Iowa Supreme Court had KO\u2019D an appeal by Chris Soules<\/strong><\/a> in his fatal crash case.<\/p>\n The Bachelor star was charged with leaving the scene of a car accident last April in connection with the death of 66-year-old Kenneth E. Mosher.<\/p>\n Soules, 35, was arrested on April 25, 2016, in Iowa after he reportedly crashed his truck into a tractor and into a ditch.<\/a><\/p>\n He allegedly refused to leave a home he was at until officers obtained a search warrant several hours later.<\/p>\n PHOTOS: \u2018Take Responsibility!\u2019 Chris Soules & Family DO NOT Attend Hit-And-Run Victim\u2019s Wake<\/a><\/p>\n Iowa State Patrol alleged that he fled the crash scene, violating the Iowa code that states: \u201cIf the accident causes the death of a person, all surviving drivers shall remain at the scene of the accident except to seek necessary aid or to report the accident to law enforcement authorities.\u201d<\/p>\n Soules entered a \u2018not guilty\u2019 plea in May and his lawyers filed a motion to dismiss the \u2018failure to remain\u2019 charge on constitutional grounds, refuting the last sentence of the Iowa state code<\/a>.<\/p>\n His lawyers contended that: \u201cbecause Mr. Soules indisputably stopped his vehicle, returned to the injured driver, contacted law enforcement, provided aid to the injured driver, arranged for medical treatment for the injured driver, remained until emergency personnel responded to the injured party, and provided identification data, the State\u2019s charge must be dismissed.\u201d<\/p>\n However, this request was denied in January and was then taken to the Iowa Supreme Court \u2013 but this request was denied on Friday<\/a>.<\/p>\n PHOTOS: \u2018Bachelor\u2019 Chris Soules Attends Court In Jail Jumpsuit After Deadly Hit-And-Run Arrest<\/a><\/p>\n A statement read: \u201cUpon consideration, the application for interlocutory appeal and request for stay are denied.\u201d<\/p>\n A date for Soules\u2019 jury trial will be set Monday \u2013 leaving the scene of a fatal car crash is a class D felony in Iowa<\/a>.<\/p>\n If convicted the he could face as many as five years in prison.<\/p>\n
