{"id":123666,"date":"2019-03-29T13:06:54","date_gmt":"2019-03-29T10:06:54","guid":{"rendered":"http:\/\/ww-vb.mine.nu\/w108\/judge-rules-new-york-gravity-knife-ban-unconstitutional\/"},"modified":"2019-03-29T13:06:54","modified_gmt":"2019-03-29T10:06:54","slug":"judge-rules-new-york-gravity-knife-ban-unconstitutional","status":"publish","type":"post","link":"https:\/\/hameed.nwar.uk\/sa\/judge-rules-new-york-gravity-knife-ban-unconstitutional\/","title":{"rendered":"Judge rules New York \u2018gravity knife\u2019 ban unconstitutional"},"content":{"rendered":"<p> [ad_1]<br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/thenypost.files.wordpress.com\/2019\/03\/gravity-knives-692-1.jpg?quality=90&amp;strip=all\" \/><\/p>\n<div>\n<p>A federal judge ruled on Thursday that <a href=\"https:\/\/nypost.com\/2016\/06\/29\/district-attorneys-band-together-to-oppose-switchblade-bill\/\">the state law that bans<\/a> \u201cgravity\u201d knives is unconstitutional because it\u2019s too difficult to enforce.<\/p>\n<p dir=\"ltr\">Federal District Judge Paul Crotty specifically mentioned a so-called \u201cwrist-flick test\u201d used by <a href=\"https:\/\/nypost.com\/2016\/05\/21\/manhattan-da-protests-bill-to-ease-blade-restrictions-in-state\/\">Manhattan District Attorney Cy Vance\u2019s office.<\/a><\/p>\n<p dir=\"ltr\">The test, used by cops who attempt to open the knife by flipping it, is arbitrary and shows that the law is too difficult to enforce, the judge said.<\/p>\n<p dir=\"ltr\">\u201cThe wrist flick test is just absurd,\u201d said Martin LaFalce of The Legal Aid Society. \u201cIt\u2019s absurd that criminal liability turns on the athletic skill of individual officers.\u201d<\/p>\n<div class=\"embed-vimeo\">\n<p><iframe src=\"https:\/\/player.vimeo.com\/video\/316864880?dnt=1&amp;app_id=122963\" style=\"position:absolute;top:0;left:0;width:100%;height:100%;\" frameborder=\"0\" title=\"NYPD Wrist Flick 3\" allow=\"autoplay; fullscreen\" allowfullscreen=\"\"><\/iframe><\/p>\n<\/div>\n<p dir=\"ltr\">Under Vance\u2019s method a police officer who isn\u2019t very good at flicking open a folding knife could give it four or five tries before it locks into place \u2014 and it could still be considered a gravity knife, Crotty said.<\/p>\n<p dir=\"ltr\">The ruling ruling pertains to a suit filed by Joseph Cracco, a sous chef who works in Manhattan and who was arrested in 2013 at Grand Central Station for carrying on his belt a folding knife that he uses for work.<\/p>\n<p dir=\"ltr\">Cracco said it took the arresting officer four or five attempts to open the knife with the wrist-flick method.
